Below is a copy of what I handed out during Agenda Item No. 7 – Brea Dam Recreation Area at tonight’s park and rec commission meeting.  It provides proof that the Management Agreement deal we entered into with American Golf in December 2010 will cost the taxpayers between………………

4,000,000 to 5,000,000 dollars in lost net revenue (think net income) over 20 years over the lease contract already in place.
This raises serious questions about how the Park and Recreation Department has been managed and calls into question our city leadership all the way up to the City Manager.  It is now time for the City to answer questions honestly and with much specificity.  Please review the below carefully.

Please note that there was no discussion about this handout except for my description and summary of it.  With the exception of Commissioner Silva, who reluctantly spoke out of order and after the proceedings were over and his vote was cast, and myself, all other Commissioners present voted to Receive and File my document and the attached presentation of the department.  Yes we have major problems with our City Government.

Average yearly loss for city by changing from former Lease agreement to Management agreement ($420,000 – $216,677) = $203,323
Overstatement of average net revenues under the Management agreement = $553,400 less $216,667 = $336,332.
Alice Loya claimed on 11/2/10 before council that the Mngmnt. A. would net an additional $133,480 dollars to the city while in fact it lost $203,323 dollars.
*  Total series A Principal $2,705,000/20 years = $135,250 + (total series A interest $2,475,381/20 years = $123,769 x .55 = $68,073) = $203,323.
  Therefore, Ms Loya’s presentation to the council that this change from a lease agreement to a management agreement would over the course of the bond  bring in more revenue to the city was in fact not correct.
Over the course of the 20-year life of the RZED Bond, the city will loose conservatively at least 4,000,000 dollars in net revenue and at the same time  it takes on liablilites that did not exist under the former lease agreement.
Please also note that under the lease agreement city revenues would have increased based on the increased gross revenues from the golf course which was  already up over 13% from FY 2011 to FY 2014/2015 as reported by Ms. Loya in January, making this an even worse deal than the numbers above show
Finally, the amount Ms. Loya presented to the committee last month for the Management fee for FY 2014/2015 of $587,000 is understated by $103,302 as the correct amount is actually $690,302 ($670,000 in base year times three one percent annual increases per contract terms.)
  The RZED Bond Debt amount per Ms. Loya is also grossly understated.  The correct amount is (100K principal + ($185,550 int. X .55 = $102,053)  = $202,053 and not $107,000 as Ms. Loya reported to this committee last month.
Conclusion:  The numbers as presented by Alice Loya to council on 11/2/2010 and on 01/11/2016, to the Park and Recreation  Committee, misrepresent the financial benefit of the Management Agreeement  (M.A.) over the former lease agreement.  This resulted  in the council approving a  M.A. that will cost the taxpayers 4 to 5 million dollars in lost net revenue over 20 years.

reports of claims activities on a schedule and in a format reasonably acceptable to the City. City understands and agrees that with respect to all policies of insurance required under this Article 4 (whether such policies are maintained by City or by AGC), the portion of any losses, damages, and expenses paid with respect to such claims which is subject to a deductible amount or a self- insurance or a self-assumption amount shall be the sole responsibility of City. If at any time during the term of this Agreement, City desires to assume responsibility for handling of claims, the parties may amend this provision as provided in Section 11.8, subject to (i) the approval of the applicable insurance companies, and (ii) the reasonable approval of AGC.


In addition to the costs and expenses to be reimbursed to AGC pursuant to this Agreement, City shall pay AGC the Management Fee computed and payable as follows:

5.1 Management Fee. In consideration of AGC’s services during the Operating Period, City shall pay to AGC a “Management Fee.” For the first twelve (12) months of the term of this Agreement, the Management Fee shall equal Six Hundred Seventy Thousand Dollars ($670,000) per annum (i.e., Fifty Five Thousand Eight Hundred Thirty Three Dollars and Thirty Three Cents ($55,833.33) per month). The Management Fee shall increase on each anniversary of the Effective Date (until termination of this Agreement) by one percent (1%) of the Management Fee in effect immediately prior to the applicable increase. The Management Fee shall be paid to AGC, in equal monthly installments, in accordance with Section 5.2 of this Agreement.

5.2 Payment Schedule. If the Commencement Date does not fall on the first day of the month, then the Management Fee for the first partial month of the Operating Period shall be the pro-rata portion of the Management Fee and such amount shall be payable on the Commencement Date. Commencing with the first full month of the Operating Period, City shall pay AGC the Management Fee monthly in advance on the first day of the month to which it pertains.


6.1 Bank Accounts. City shall establish bank accounts for the Facility at a banking institution or institutions reasonably selected by City, (which banking institution or institutions shall have branches located in close proximity to the Facility), such accounts to be in City’s name (the “City Accounts”). AGC shall also establish bank accounts for the Facility at a banking institution or institutions reasonably approved by City, (which banking institution or institutions shall have branches located in close proximity to the Facility), such accounts to be in City’s name (the “Facility Accounts”). AGC will deposit into the City Accounts all monies received by AGC from the operation of the Facility. City shall deposit all funds required to be furnished by City as working funds under Section 6.3 of this Agreement into the Facility Accounts, and AGC will disburse those monies from the Facility Accounts only for the purposes set forth in Section 6.2. Notwithstanding the provisions of the foregoing, AGC shall be entitled to maintain funds in reasonable amounts in “cash register banks” or in petty cash funds at the Facility.

    The fact that not one question was asked of me by any committee member based on my presentation was mind boggling and incredibly disappointing to me. The fiduciary responsibility of this committee and this department sank to a level that the biggest cynic would find hard to believe. But there it was staring me in the face as I witnessed it all on the dais. What conclusion can any rationale human being come to but that this department (including Alice Loya and Hugo Curiel) and commissioners Karen Lang-McNabb (Doug Chaffee appointee), Gretchen Cox (Mayor Fitzgerald appointee), Scott Stanford (appointee at-large) and Michael Savage (appointee at-large), seem to be more concerned about hiding and burying potential wrongdoing/mismanagement then learning more about it and taking relevant and prudent action. Each of the above had no comments to my presentation and then voted to File and Receive or in other words bury this extremely important and very enlightening information. This is not leadership. This is not good government. This is not government acting with integrity. This is certainly not the way a fiduciary body should ever act. But that was exactly the sad and pathetic course this Park and Recreation Committee chose on Monday night, March 14, 2016.

          The problem is not that Mr. Levinson was ignored at the Parks and Recreation Committee meeting and at the Fullerton City Council meeting. The very serious problem is that a high-level employee of the Parks and Recreation Department, Alice Loya (Administrative Manager) would recommend to the council to vote for a very bad deal for the citizens of Fullerton and continue to provide false information on the same subject five years later in January 2016 to cover up her original lie, grossly negligent errors or malfeasance in November of 2010 before the Parks and Recreation Department. In the private sector, Ms. Alice Loya would be fired and the company would probably bring civil charges against her for restitution.

    Wow to witness the exposure of blatant corruption of the Fullerton Park and Recreation Department and realize that this corruption probably did not end with the P and R department but very likely had to be orchestrated and or blessed at the top. The commissions and the department’s voting to File and Receive this issue after Mr. Levinson’s presentation was breathtaking in its exposing all those individuals in an obvious coverup of the truth. They need to resign immediately from that committee. Mayor Fitzgerald’s new appointee was probably following the Mayor’s orders in trying to squelch any dialog. This should be the last straw for Mayor Fitzgerald.
    Barry thank you for being the lone person in city government with the courage and integrity to do the right thing.

The same Joe Felz who was promoted to this position from his former position…..you guessed it as Director of the same Fullerton Park and Recreation Department and whose direct report was you guessed it….Alice Loya. Did I mention that prior to being Dept. head for Parks and Recreation, Mr. Felz was the Assistant City Manager under Chris Meyer?

    Tonight I watched the Fullerton City Council meeting. I saw Mr. Levinson present that Ms. Loya presented faulty numbers to the council in 2010 with a faulty conclusion that the Management Agreement was a better financial deal for the city. Therefore Ms. Loya recommended that the council approve the Management Agreement. Then I watched the segment where council can speak on any topic including the just concluded public comments. Each and every council member ignored Mr. Levinson’s comments. Council member Whitaker addressed the woman who said her company could perform the fixing of Laguna Lake cheaper than the company the city hired. He was concerned that we could have gotten a better deal. Now the deal the city chose was for a sum of approx. 500K. So a better deal might save the city 50K or 100K or some similar amount. Mr. Levinson talked about the city squandering 5 million dollars over the 20 year period of the 2010 bond issue. Once again Council member Whitaker took the politically safe way out by talking about Laguna Lake and not what appears to be the intentional loss of 5 million by the city. It appears that none of our council members are up to the task of looking out for its citizens 100%.

      Sure they are. They just choose to ignore Barry and Joe no matter what they say. It’s really that simple. City Manager Feliz and Chief DannyBoy do the same thing. It comes to a point in time where if someone accuses you of things that aren’t true over and over and over and lies about you over and over and over, you just choose to ignore them in the end. That’s what is going on now. It happens all the time in politics, especially at the City level. If you go to any city anywhere in this state, there will be someone or a few people that are at every single city council meeting complaining or whining about something. No one listens. They just let them talk and don’t hear a word that person says. That’s where Joe and Barry are at right now. No one hears anything they say, except a few people on this blog. It was the same thing with Tony Bushala and Travis and his Klan back when they bought their way onto the city council with Tony’s $500,000 and the blood from Kelly.

      When an extremely serious problem is presented to all members of the Park and Recreation Committee as well as all members of the Fullerton City Council by Mr. Levinson and not one of them bothers to ask him one question combined, you have a classic case of a corrupt city council that has no problem ignoring their fiduciary responsibilities.

      The fact that Mr. Levinson was totally ignored by the council member who appointed him, Mr. Whitaker is even more mind boggling and disturbing. There is absolutely no way Council member Whitaker can justify his total abdication of his council responsibilities with regard to that matter. Mr. Whitaker it was you who should have resigned from the council sir and left Mr. Levinson to continue to do the good work for the people of Fullerton you and your colleagues shamefully refuse to do sir.

      Finally, it should make every Fullerton citizen that voted for Council member Whitaker extremely angry to realize that he helped to bury the truth about the Fullerton Golf Course Management Agreement with American Golf Corporation and the related bond issue that combined will cost the taxpayers 4 to 5 million dollars over a 20 year period.

    I watched the city council meeting too. What I saw was grown men making total buffoons out of themselves. Imbriano saying the city is for sale after the council’s very routine action of turning former redevelopment property back over to the city. This imbecile didn’t have brains enough to know that RD agencies no longer exist and that moving those properties back over to city ownership is merely an administrative action. Then, when the inventory of city owned properties was presented (a request by Imbriano’s man Whitaker, by the way), this dunce goes on another Fullerton-is-for-sale rant. Whitaker then makes the very correct statement, saying the city SHOULD NOT own too much land, and in fact, sell off some properties to give private enterprise a chance to thrive. I won’t even begin to comment on the item where Imbriano, Levinson and Curley criticized the council’s action to make alleys city property (Something Imbrianos’ other man, Greg Sebourn has been pushing for). Imbriano, Levinson and Curley behave more like Mo, Larry and Curley. It would be funny, if it didn’t drag out meetings hours longer they they need to be.

    It is clear that Fullerton has a dearth of courageous leaders. We have City Manager Joe Felz stating at the March 1, 2016 city council meeting that he was in favor of selling the Hunt Library and its property to Grace Ministries in a sole source transaction and then when Mr. Levinson repeated it during March 15, 2016 public comments, Mr. Levinson indicated that Mr. Felz was shaking his head no up on the dais. So I guess we have no courageous leaders and in Mr. Felz case, a city manager that has difficulty remembering what he admitted to a scant two weeks ago. I can not wait for another Fullerton establishment candidate hack giving us the slogan of transparency in City of Fullerton Government. These corrupt politicians are becoming so, so predictable in their deceit.

    This post has motivated me to comment here. I like most people have a pretty low overall opinion of politicians. The city of Fullerton has always done nothing to change my opinion. However, this post has changed my opinion of Fullerton City Government for the worse. They truly are scraping the bottom of the barrel. I guess they are now showing their true colors. They are lacking decency, honesty and integrity by the boat loads. I think it is time to clean house of city council and city department heads. Anything less will not cleanse this city of the deep and entrenched corruption we have seen in in the past and that continues to rear its ugly head in the present.

Now it is so clear who Fitzgerald, Flory and Chaffee represent and like you said Mr. Levinson is surely is not the citizens of Fullerton

    When the city hierarchy has control over all employee salaries and benefits you have undemocratic socialism.

    Why? The politicians are bought by the police and fire unions and agree to spend taxpayer monies that are not currently available in exchange for campaign cash and support.
    The federal reserve has been afraid to raise interest rates from 0 for the last 4 years because they can’t meet the desired inflation rate of 2 percent. But a city with a 2.8 million dollar deficit, roads from hell and a water and sewer system to match says no problem to 6% raises for police and 9% raises over tow years for firemen. Undemocratic socialism used to be called communism. Where the government apparatus runs everything without input from the common man and woman. But wait you say, in communism there are not free elections. But I say almost everyone running for city council is corrupt, we too no longer have truly free elections either. We did win the cold war but they are winning the war of fundamentally changing the American way of life. Either wake up and speak out or accept this is as the new norm. The amount of time that we have to make the necessary changes to restore our representative democracy is fading fast.

The girl who was so called sexually abused was involved in a consensual relationship with the Detective. She liked to do the hanky panky but then saw money signs and went for the money instead of the meat. Simple. Of course she has issues. She had issues before and always will. Keep bringing up topics of many many years ago. That just keeps reinforcing what a great job Fullerton PD and the City are doing when you can’t even bring up anything current as an issue.

    Status: It is now a full week since I provided detailed proof at the Park and Recreation Committee meeting that the analysis provided to our Fullerton City Council by Alice Loya of Parks and Recreation Department on election night November 2, 2010 and again to the Park and Recreation Committee on January 11, 2016 as agonized by me was deeply flawed with errors/misinformation or worse resulting in a very bad deal for the city with a cost over 20 years of 4 to 5 million dollars. This same message was given to the City of Fullerton City Council the very next night. Not one city employee, not one city commissioner, not one city council member has even attempted to contact me with any inquiry into this matter. The silence is both deafening and sickening. Apparently not one of those individuals charged with fiduciary responsibilities for the city is even the slight bit interested in learning about this troubling development that I have uncovered. Well there is one volunteer, unpaid member of the Park and Recreation Committee that cares a great deal and it is yours truly. This could potentially rise to the level of a criminal act by city employees and yet where is our City Attorney and our Fullerton Police Chief. Where is all that transparency they all like to talk about so much at City Hall?

      I support facts and justice. When someone is found not guilty I support that finding. When someone brings up things from years ago as current, I take that for what it’s worth. Nothing.

        Yes the Fullerton establishment is getting extremely worried. You see all their schemes so far have been thwarted and they have spent the city into such a deficit that it will be almost impossible to right the city’s financial ship. First they will go into the city’s reserves but that will not last forever. I suspect before the city faces bankruptcy our anti-heroes Joe Felz and Dan Hughes will go off into the sunset together with their combined 400K retirements not willing to face the disaster they had such a huge hand in creating over their tenure.

    It is now 11 full days since I gave and provided copies of my detailed presentation with support for my calculations. It showed that over a 20 year period of the bond issue (used to finance the Fullerton Golf Course irrigation system), that without major changes to our Management Agreement with the American Golf Corporation, the cost to taxpayers will be between 4 to 5 million dollars. Since that time not one person from the Parks and Recreation Department or from the City Manager’s Office or from my fellow Committee members has contacted me to ask me any questions or to discuss my troubling findings. It is now 10 days since I gave a shortened i.e. 3 minute presentation during public comments in front of our Fullerton City Council. Again, not one council member, not one member from the City of Fullerton Government has attempted to contact me with any follow-up questions or a request to discuss these troubling findings with me. Council member Whitaker did text me a week later asking for a copy of my presentation and I responded the same day that an official copy was already given to the city at the Park and Recreation meeting and that it was also available online at fullertoninfomrer.com and linked to my Facebook page as well. In addition, fullertoninformer.com has the original video of my complete presentation during the last Park and Recreation Committee meeting. The only question I have for all the referenced people above is WHY the silence? I sincerely hope that a discussion will be started by one or more council members at the next Fullerton Council meeting and that it will be placed on the agenda at a future council meeting to be discussed formally and with much specificity. It is also my hope that all questions that I have raised are answered completely and honestly by those involved, which would include Alice Loya and then Acting City Manager Joe Felz (who signed the contract in question for the city). The citizens of Fullerton deserve full disclosure. Unless the city can demonstrate with supporting documentation that my concerns are totally baseless, action on this item must occur sooner rather than later.

    You can always spot a corrupt city by the condition of its infrastructure….roads, sidewalks, sewers, water pipes. Also are they shrinking services such as selling libraries (Hunt Library – Joe Felz recommended selling it as a sole source sale) and reducing the hours of the remaining library. Add in a rogue police department that protects rather than punishes the worst of them and you have just described Fullerton perfectly.

    I will go ahead and describe a small part of what criminal behavior continues to go on at the FPD.

    Ronald Bair preying on a woman in a shelter for battered women decides she deserves to be battered, abused physically, sexually and emotionally by him as part of his on duty FPD service. When she balked at the continued sexual, emotional and physical abuse, he then went to the courts and made outrageous bald faced lies under oath which caused her to loose custody of her children.

    Bair is the consummate degenerate criminal operating under the color of FPD authority and it cost the city of Fullerton $550,000 in a closed door civil suit to make this issue go away, i.e. bury it from further exposure to the public. Mr. Bair would have and most definitely should have been charged with multiple criminal charges if not for the corruption of the FPD. But as a key part of the lawsuit stated that FPD management, (and who is the head of FPD management but none other than our own self-proclaimed Mr. Transparent, Mr. Non-political Police Chief Dan Hughes), worked to help Bair and ignored her pleas for justice.

    Lastly, there is no LOL here. No Lots Of Love or Laugh Out Loud. Only another degenerate would describe this situation that way Reality Is.

    The contempt shown by our city manager and council to hold that meeting at that ridiculous date and time is a new low for our council.

    It goes on and on and on. There is not only so much proof positive that the FPD is corrupt but that it is institutional corruption that never seems to end for the good people of Fullerton.

    Dan Hughes and Joe Felz should retire immediately. Mayor Fitzgerald should either quit the council or quit her VP job at Curt Pringle and Associates. She can’t serve two masters with such built in conflicts of interests. If she truly loved Fullerton, if she even truly liked Fullerton she would do this immediately.
    But knowing Mayor Fitzgerald I would say….don’t hold your breath Fullerton.

    Once again the totally deceptive tactic of making a false statement, i.e. the Hunt Library was not used by the public, to argue for its sale. There are many great reasons to keep this property for the people of Fullerton. Unfortunately our city council and city manager are only interested in trying to find at least some of the money needed now to pay for the extravagant raises just handed out to the police (6% raise next year) and fireman (9% raise over 2 years). I guess you could call the sale of Hunt Library a “Fire…and Police Sale”. It is such a shame that time and again we see our safety employees have only one major concern and that is to serve and protect themselves. Well the sham has been uncovered and we are hear to sound the alarm.

      I recall Ms. Fitzgerald could not wait for a police report or even the end of the investigation before angrily calling for the resignation of Mr. Levinson from the Park and Recreation Committee, which was eventually filed by FPD as a misdemeanor and the supposed victim at council could not even remember being victimized.
      Yet there is no comparison between the unfounded misdemeanor allegations against Mr. Levinson and the alleged violent criminal acts of FPD Detective Ronald Bair against a woman he first met on duty in a shelter for battered women. The allegations must have had merit or else the city threw away $550,000 dollars of our hard earned tax dollars.

      Now what has Mayor Fitzgerald and Council member Flory said about these allegations when they first were brought to light…..Nothing!
      Now what has Mayor Fitzgerald and Council member Flory said about these allegations after the city paid $550,000 to ensure that the details of the accusations remain under seal….You guessed it Nothing!

      So let us please review the actions or non-actions of Fitzgerald and Flory and that is the following: No matter what vile, disgusting, degenerate and criminal acts are allegedly committed by one of the FPD finest, these two stalwart supporters of women’s rights are completely silent. I am sure you have heard of the old saying….If it looks like a duck, acts like a duck and quacks like a duck then it must be a duck. Unfortunately both Ms. Fitzgerald and Ms. Flory are much, much worse than a duck. Did I hear someone say?….PHONIES AND HYPOCRITES.

    It is now 27 days and counting, since I provided copies of my detailed analysis to the Park and Recreation Committee on March 14, 2016. Yet no one with a fiduciary responsibility in this city…the Council…the City Manager Joe Felz… the Administrative Manager Julia James…the Park and Recreation Director, Hugo Curiel…or the Park and Recreation Administrative Manager, Alice Loya has responded in any way to my analysis.

    I guess the city is running such a huge budget surplus that correcting even in part, 5 million dollars in lost net revenue does not concern anyone. Oh that is right, we do not have a huge budget surplus but we have a current 2.8 million dollar budget deficit over the next two years that is probably only getting much bigger due to the ongoing extreme generosity of Fitzgerald, Flory and Chaffee to give huge multi-million dollar raises to our city employees. Besides myself, I do wonder if there is anyone in authority in the City of Fullerton who is concerned about the taxpayers of Fullerton. I really thought that at least one or two council members were concerned with the financial wellbeing of the city but then again why are they totally silent now.

    Please city of Fullerton elected and appointed officials, do not be shy and speak out for the people of Fullerton. Twenty seven days and counting and the number of city of Fullerton elected and appointed officials to speak up besides me still is a big fat ZERO!

    I guess maybe the City of Fullerton leadership is hoping to become the corruption capital of Southern California, taking over 1st place from such noble institutions as the City of Bell and the LA County Sheriff’s Department. Well ladies and gentlemen of Fullerton if that is not their intent I suggest they actually start to deal with some of the very severe problems facing them.

    it is clear to me that Mr. Levinson is counting the days after everyone in city government was put on notice that there is something very wrong with the Fullerton Golf Course deal. It is also clear to me that anyone who remains silent after all the factual information and analysis done by Mr. Levinson is not part of the solution but obviously part of the problem. Therefore, every council member and every Park and Recreation Committee Member except for Mr. Levinson need to be thrown out of city government. First step vote against all the incumbents in November and then new council members will have to appoint new committee members.
