A radidly growing company wants to BUY a piece of land that the taxpayers of Fullerton own. PUBLIC LAND SHOULD BE SOLD FOR THE HIGHEST PRICE AND BE CONSISTENT WITH WHAT IS ITS BEST USE TO BENEFIT THE COMMUNITY. Jobs and a tax base should be the priority. Sounds like a no brainer right? Wrong because Fullerton is run by crooks who work deals with their crony pals.

This company wants to come to town and expand their business and hire and employ people. Sounds like a great idea. Well the Fullerton city council wants to rezone this parcel from residential to housing for the homeless and give it away for FREE to a non profit that has no money. 10 MILLION DOLLARS WORTH OF LAND FOR FREE!!!
The non profit Pathways of Hope wants to RIP OFF THE TAXPAYERS AND RESIDENTS BY TAKING THIS TEN MILLION DOLLAR PARCEL FOR FREE FROM THE CITY AND use this 10 million dollar parcel to build their new corporate headquarters and  to build a wharehouse to put up homeless people.This large parcel of land that belongs to the taxpayers is set to be given away to a non profit that has no money to build homeless housing for drug addicts and ex cons in a residential area.  The title of the article is self descrptive. THIS IS A HEIST. This is a land grab by a greedy non profit to set up a permananet base in Fullerton ON OUR DIME to get their fangs into the jugulars of the tax payers and suck the grant money out of the coffers.
If we don’t stop this, they will build it, and apply for grants from the feds state and county to EXPAND with our tax money and these things will start popping up everywhere including single family homes.
Under state law Pathways can start running recovery homes too and the city or you and I will not be able to stop them and that will be a breeze because they will be awash in cash from all the grants to fill the streets with these people.  This is insanity. A non profit THAT HAS NO MONEY OF THEIR OWN , pathways of hope, wants to steal our land that belongs to the taxpayers by conning the crooks on the Fullerton city council to give them the land AT 1600 W COMMONWEALTH for free that is worth TEN MILLION dollars so the non profit can USE TAX MONEY TO BUILD THEIR CORPORATE HEADQUARTERS AND set up a revolving door flop house full of mentally ill people, junkies, and ex cons, right in a residential neighborhood? Why would a non profit be so inclined to rip off the taxpayers and ruin our neighborhood by building their corporate headquarters and homeless housing ripping us off again by using tax money to build it right after they rip us off and get the multi million dollar parcel of land for nothing?
Well it is because when they build it they will come and get millions in grants to run this mill and expand it to other locations in Fullerton. Meet the man who stands to make the most money at the helm of this taxpayer heist.

Our “Good Friend” Dr. Mark H. Shapiro Following the Saul Alinsky Playbook To A Tee! By Barry Levinson

Here is part of his comment in response to a posting by David Curlee about the proposed changes to the Fullerton Firefighters Contract Agreement.

“With regard to Curlee’s gratuitous comments about pension contributions, let me just say that my first real job in life was as a firefighter for the U.S. Forest Service on the Angeles National Forest where I earned some money to help out with college expenses. The one think that I learned from that experience is that firefighters earn every penny they receive in salary and benefits. They work under the most adverse of conditions, and deal with more tragedy in a week than most of us see in a lifetime. Many of them die early from cancer and heart disease.”

The gratuitous comment relates to Curlee mentioning that one way to solve the problem of reducing the number of fire vehicles from 6 to 5 within Fullerton would be for the Firefighters themselves to pay more for their contributions for their extremely generous taxpayer funded pension. To a lefty like Dr. Shapiro, that statement must have been blasphemy.

But by following the advice in Rules for Radicals by Communist Saul Allinsky, Dr. Shapiro is accusing David Curlee of exactly what he himself has just done above. He makes a totally unsubstantiated and I believe basically factually incorrect statement to support the Fullerton firefighters. That sir is not only gratuitous it is false.

He states referring to firemen that “many of them die early from cancer and heart disease”. And Dr. many of them live to be 90 years old as well collecting 90% of their final pay plus health care for the next 40 years in retirement. In every group some die younger than the average and some die older than the average as you obviously know sir. He also stated that “They work under the most advert of conditions, and deal with more in a week than most of us see in a lifetime.” I guess Dr. Shapiro believes that firefighters who work a three day shift weekly and deal with a few if any dangerous fires in a typical year in Fullerton is hardly ‘the most adverse of working conditions”. It has been statistically proven that working at a 7-11 Convenience store is much more dangerous than being the typical firefighter, yet they make minimum wage, rather than the 6 figure salaries and the early rich retirements that all Fullerton firefighters receive from the taxpayers of Fullerton.

Nearly two-thirds of all homicides in the retail trade sector during the 2003–2008 period occurred in two types of retail establishments: food and beverage stores (41.4 percent) and gasoline stations (22.0 percent). The other third were distributed among 10 other types of retailers, including motor vehicle and parts dealers (8.4 percent), clothing and clothing accessories stores (6.8 percent), and general merchandise stores (4.9 percent).

Finally police unions have been lying to the public that police officers die earlier than the average man in America. False! In fact the last study showed that on average a police officer’s life expectancy is about the same as the average male in America.

No one is saying that a firefighter or a police job at times can be a dangerous profession. But greatly overstating that danger and lying about their average life expectancy and overstating how bad their work conditions are is simply muddying up the waters at best or lying at worst.

Shame on you Dr Shapiro, to throw out so much misinformation in a failed attempt to try to attack David Curlee’s legitimate concerns about our fire department.

The new homeless shelters at Grace Ministries, EV Free Fullerton and Eastside Christian Churches

Today the riverbed encampments that have been home to upwards of 1000 homeless men, women and children have reached the end of the line. All of these people need the forgiveness and the power of Jesus Christ to truly set them free from their addictions to heroin, alcohol, methamphetamine, and prescription drugs. Some need mental health care, some just need a small amout of financial help to get them back on their feet. Some are in dire need of medical and dental care. We know the government ruins everything they get involved in and that is by design. The government is secular and godless. The church of Jesus Christ has been commissioned to restore and renew the world. It has been bestowed with the responsibility by Jesus Christ himself to care for the sick, set the prisoners of addiction free, to restore lives, to care for the widows, the oppressed, the fatherless and the poor.  Well the evictions have begun and the homeless have nowhere to go for help or do they?

EV Free Fullerton

EV has plenty of room to house the homeless.

They recently spent close to $20,000,000 to build a parking structure that sits empty 6 1/2 days and 7 nights a week that is big enough for 550 parking spaces which is almost 200,000 square feet. It is well lit and provides excellent access to the sanctuary that EV Free recently spent $5,000,000 to remodel which seats around 1000.

They also own multiple apartment buildings and the shopping center across the street. They currently are spending another $1,200,0000 on more rennovations.

It even has a gymnasium complete with showers and a large kitchen. It could house and feed many people in need. EV Free takes in about $26,000 a day tax free and spends every dime of it.

PINEWOOD STAIRS FALLING APART AND YET STATE SENATOR CANDIDATE BRUCE WHITAKER REMAINS TOTALLY SILENT. by Barry Levinson

Bruce Whitaker buries corruption for a living on the Fullerton City Council

It has been approximately 8 to 9 months since the City’s Christening of the Pinewood Stairs connecting Hillcrest Park and Lion’s Field. The FFFF website has posted new pictures rendering the condition of those stairs. They are simply falling apart with the problems increasing at a very rapid rate.

Yet where is State Senate Candidate Bruce Whitaker on this issue? The answer is that Bruce Whitaker has been totally silent since the beginning. It is very troubling that someone whose only theme for running for State Senate is to fight Sacramento Corruption is once again totally silent on this City of Fullerton corruption and there is no doubt that is what Pinewood Stairs represents. 

Public Works director Don Hoppie needs to be fired over signing off on this outrageous fraud perpetrated on taxpayers.

$196,000 a year for Hugo Curiel and $148,000 a year for these Fullerton park and rec department managers Curiel and Loya who presided over this disaster (compensation source transparent california.com)

Sebourn mentioned his concern in response to citizen complaints and then failed to follow-up at all. Nice phony PR work Sebourn.

Worthless Bushala plant Greg Seaborn who doubles down every time with lipservice and ignores the corruption.

Fitzgerald’s response was to totally praise the stairs as a great triumph of city engineering and development.

Shawn Nelson plant Fitzgerald ignores the problem, doubles down and praises this construction defect lawsuit in the making as magnificent.

Who is one of her main supporters and mentors but none other than Shawn Nelson who is now running to replace Congressman Ed Royce. You remember Nelson, the guy who tried to put in a homeless shelter across the street from an elementary school that has many special needs children in attendance and tried to hand over a 100K commission to one of his supporters denying others the right to bid for that commission.   The same supervisor who was against setting up an independent commission to look into OC Supervisor corruption. Here is Nelson hiding SCAG from the public at a candidate forum, yes the one who lobbied his head off to make sure Jennifer Fitzgerald got elected twice and he wants to be your Congressman?

 

Is this the best the Republican Party can provide as candidates, Bruce Whitaker for State Senate and Shawn Nelson for U.S. Congress? How pathetic? And the State Republican party wonders why Republicans have become pretty much meaningless throughout the entire state. A state that gave us Governor and then President Ronald Reagan. Should those true conservatives that care about our constitution and limited government providing freedom for its citizens, start a new Conservative Party in California? If the State Republican Party does not shape up and shape up really fast, the answer is probably yes!

As for the stairs, well you know you can’t put wood in concrete like that. It swells every time it gets wet. It should have had metal anchors with straps and bolts. So if the City doesn’t sue the contractor for construction defects, no one gets fired, no one goes to jail for this total ripoff, and someone gets hurt when this thing ends up red tagged after the next big rainstorm, well you know it will be you picking up the tab once again.

Joe Imbriano questions why Fullerton has totally abandoned almost all street repair for decades. All other surrounding cities have the same issues with out of control pensions, payroll, and benefits costs and yet these surrounding cities have managed to repave all of their streets year after year and keep their streets in workable order.

We want answers and we aim to get them. Use your head folks, do the math. We are not talking about advanced math, just basic elementary simple math. 90 percent of our roads are total shit folks and the result of city officials, city employees and elected representatives completely and totally ignoring the problem, and not just for years but for decades! This means that there has been 30 plus years of elected and appointed officials who have failed to do their jobs in the most rudimentary way and it is past time that all of them collectively be held to account. Some of these leaders act less like the gods that they think they are and really act more like the godfather. 

Meanwhile, Fullerton, with its huge property tax and sales tax base has its streets, water mains, and sewer pipes, almost all 200 miles of them crumbling in ruin while these stool pigeons on the council look the other way and push for massive highrise development and dirty favors for their crony pals. No longer will this and other issues be ignored.

Open your eyes. Something is seriously wrong in Fullerton that in my opinion, is going to make the Bell and Beamont scandals look like a lemonade stand heist.

Robert Pletka’s FSD crossing the line: turning fundraising into homework to pay for drinking fountains.

I believe that Robert Pletka, along with many others, but above all others, belongs in jail for irradiating the 15,000 students in the FSD for four long years now. 

No school district official in the entire country has willfully ignored the facts more than Robert Pletka on the imminent harm facing the students in the Fullerton School District from the reckless and dangerous wireless technology programs this man has advanced and deployed. Forget the device addiction issues he has caused thousands of students. No school district official in the entire country has been exposed to and ignored more competent evidence of harm when it comes to what endangers the students in the Fullerton School District than this man.

ROBERT PLETKA has spent almost $10,000,000 dollars of taxpayer money on dangerous wireless technology over the last four years WHILE THE SCHOOLS REMAIN IN HORRIBLE CONDITION and now ONE OF HIS TEACHERS has her students fundraising for DRINKING FOUNTAINS AND CALLING IT HOMEWORK! 

 

 

This is clearly a misappropriation of district funds, employee time and a violation of board policies. This is really all about bribing the children, taking advantage of the children, and abusing the system. The children are ostensibly at school to learn, not to be politicizing or carrying water for the wasteful district officials or its employees. This so called homework assignment has nothing to do with learning or the school’s curriculum. It has everything to do with plugging holes in the budget caused by bloated out of control salaries.

Water is a basic right. The FSD is not about “putting the kids first” or providing “a safe learning environment“. If they were, they would have had the lead flux oozing, filthy, disgusting drinking fountains replaced years ago with new ones that filter out all the toxic chemicals being added to the water. Oh yes, they teach the students to recycle when there are upwards of 10,000 plastic water bottles being used and discarded every day by the students. They should have spent the money years ago to provide filling stations. They only cost about $800 each. Adding Reverse Osmosis to each one would add about $200. The students deserve good clean water to drink during the day and thier parents should not be asked to pay for it again when their taxes already go to the district for maintenance and operations.

You would think the PTA would have done something years ago? The school foundations? No, they were too busy raising money to irradiate the students with iPads (infertility pads).

The FSD spends almost $120,000,000 a year on operations with the majority of it on payroll. Greedy teachers remain silent on everything except for when it comes to their pay and benefits.

Students and parents should never be asked to fund or finance basic need infrastructure items like water delivery systems! Well that is exactly what is going on and it is not only a fundraiser, but the FSD is crossing the line by incorporating district fundraising activities into homework and making it part of the academic requirements of the school.

Let’s have a look at the payroll of The Fullerton School District. PAGES AND PAGES OF SIX FIGURE SALARIES FOR 180 DAYS A YEAR WORTH OF WORK AND SILENCE ON EVERYTHING.

Page after page of six figure salaries and the schools are in ruin with overcrowded classrooms that Robert Pletka is trying to pack even tighter by advertising in other areas to bring in free lunch students that generate more revenue for the district and we the parents have to have our children do this to get credit for their homework?

 

Drinking fountains and water delivery systems are supposed to be paid for with our tax money that amounts to $120 million dollars a year. Why are we being asked to pay for basic needs of our children to be met that actually are consistent with the environmentalism religion being taught to these impressionable children?

 

 

What a bunch of frauds. If Robert Pletka cared about the kids, and if he wasn’t so drunk on wireless technology, he would have made drastic improvements in the conditions present at these schools years ago, most notably the disgusting drinking fountains. He did no such thing.

 

 

 

As a matter of fact, Pletka, The PTA and district staff doubled down and went full steam ahead and put dangerous wirless iPads in the laps of every child in the FSD . Instead of providing clean water and a safe classroom environment, they chose to go along with the forced exposure of children to dangerous microwave radiation and forced the children to drink from untested water sources that deliver toxic lead right into their mouths.

When unsafe levels of lead are found in drinking water, the culprit has typically been lead pipes or lead-containing brass and bronze fittings, but in a new study researchers clearly show that lead present in the zinc coating of galvanized steel pipes can be a very significant long-term source of lead in water.

Why is the FSD, its teachers, staff, and board members all complicit in this?

 

Who is the principal of Ladera Vista? Why is this taking place with this person’s approval? Since when has the learning process been allowed to be hijacked by school officials to ripoff the parents?

The galvanized pipes installed on water lines between 1880 and 1960 were dipped in molten, naturally occurring zinc. Naturally occurring zinc is impure, so these pipes were bathed in zinc that also contained lead and other impurities. The zinc coating elongated the life of the steel pipes, but added small amount of lead and other substances that could potentially harm children. Ironically, lead has the same carcinogenic classification and wireless microwave radiation according to the world health organization.

Water quality testing needs to be done at all Fullerton schools. Water filtration systems need to be installed on all drinking fountains and this needs to be done from the current budget and not from the hardworking parents who already pay their fair share of taxes to support this bloated jobs program that puts the students LAST and in harms way! Shame on the FSD and shame on you if you fail to see anything wrong here.

I was no fan of the hacks Royce was pimping but how fast, how low and how treasonous can you get in 6 months with her replacement Newman? Let us see. Well this isn’t funny anymore folks and this guy needs to be thrown out of office along with his female counter part in the Assembly, sicko Sex Ed Silva.

The con job Newman’s handlers pulled off that produced Newman’s victory gives Democrats control of two-thirds of the 40 seats in the Senate.  This is enough for them to approve tax increases, suspend legislative rules, pass emergency legislation or overturn the governor’s vetoes without any support from Republicans.

Newman voted for Senate Bill 54, which unofficially has been called a “sanctuary state” bill. It bars state and local law enforcement agencies from using their resources, including money, facility, property, equipment or personnel, to help with immigration enforcement.

They would be prohibited from asking about immigration status. They would be prohibited from giving federal immigration authorities access to interview a person in custody or assisting them in immigration enforcement.

This massive burden is one of the main reasons California’s schools and infrastructure are in a total state of disrepair. Newman works for the illegals, not the taxpayers.

Illegal alien drunk drivers kill 13 Americans every day — that’s a death toll of 4,745 per year. Annualy more than 43,000 illegal aliens, were convicted of drug offenses. The violent crime category of assault, robbery, sexual assault, and family offenses comes to 12 percent. The non-violent crime grouping of larceny, fraud, and burglary totaled seven percent, and on the list goes — equaling 100 percent of illegal aliens who have been through the criminal justice system and inflicted thousands to millions in cost per alien on the system, for issues having nothing to do with their illegal entry into the country. 

In a 2007 Government Accountability Office study of 55,322 illegal aliens, analysts discovered that they were arrested at least a total of 459,614 times, averaging about eight arrests per illegal alien: 70 percent had between two and 10 arrests, and 26 percent (about 15,000) had 11 or more arrests. Drug or immigration offenses accounted for 45 percent of all offenses, and approximately 12 percent (over 6,600 illegal aliens) were arrested for violent offenses such as murder, robbery, assault, and sex-related crimes.

FBI crime studies also shows heavy illegal alien involvement in criminal activity that revealed these statistics:

  • 75 percent of those on the most wanted criminals list in Los Angeles, Phoenix and Albuquerque are illegal aliens.

  • One quarter of all inmates in California detention centers are Mexican nationals, as are more than 40 percent of all inmates in Arizona and 48 percent in New Mexico jails.

  • Over 53 percent of all investigated burglaries reported in California, New Mexico, Nevada, Arizona, and Texas are perpetrated by illegal aliens.

Hughes said in the memo that he received a telephone call at his residence from a watch commander who reported that Felz was involved in a minor crash and that a field sergeant believed the city manager was “emitting an odor of alcohol.”

So Joe Felz, after drinking with Bruce, gets in his car, and in a residential area,  jumps the curb at 1:30 am, hits a tree, gets his car stuck, frees the car, attempts to drive off for 175 feet or so and, gets stopped by the police, smells of booze, allegedly demands that the officers call the police chief, is given a private set of sobriety tests and was allowed to delay the breathalizer, and then gets a ride home from the police, no charges, nothing to see move along now even though his car was damaged enough not to be driven to work today.

Dan Hughes apparently had at least four officers present at the scene who did not immediately conduct the field sobriety tests or administer the breathalyzer. The officers on the scene according to an unnamed source were officers Boline, Haid, G. Eibert, and Wilkerson. These officers have the experience, the expertise and  the arrest rates that get them the MADD awards at the council meetings yet they were called off of immediately testing Felz for DUI. Why is that?  That is because Joe Felz allegedly demanded that they call Dan Hughes.

Why did these officers listen to the person who allegedly demanded that they call the police chief when he smelled like alcohol after he just lost control of their car, hit a curb, and took out a tree and not make the judgement themselves to administer tests and evaluate and if necessary arrest Felz?  Why didn’t they put the cuffs on him right away? If this was you or I, they would have.

No, instead these officers listened to the City manager that smelled like alcohol, who just lost control of his car, hit a curb, and took out a tree that allegedly demanded they call  The police chief Dan Hughes instead of immediatley doing what any good police officer would do. That is to immediately administer the tests. Apparently Hughes ordered them to deviate from policy and wait for Jeff Corbett to arrive some time later to evaluate Felz without another witnessing officer present and conduct the tests. Corbett is not one of the FPD’s  field sobriety experts as he has not conducted a DUI test in years. So why delay and bring in someone who is not the most properly suited for the task? Well it is of course to control the outcome. Corbett is Hughes’s special guy.

According to an unnamed source, Corbett led Felz away from the other officers and conducted the tests out of sight of the officers present and he did it alone which is a clear violation of  FPD policy. Perhaps that is why Felz passed the test with flying colors.

Was Felz given a PAS test? Why not?

Supervising Mr. Gochenour while in the jail was FPD Officer Vince Mater who ended up serving probation after pleading guilty to destroying an audio recording of conversations he had with Dean who later committed suicide in jail.

Why would Bruce appear to come to his defense and state that he had “one beer” with him and just minutes later according to the officers on the scene reek of alcohol and yet Bruce Whitaker stated that “He (Felz) seemed to be in control of his faculties,”?  What kind of BS is this? 

What’s in it for Bruce Whitaker to step out and make a statement?  He covers his own ass.  If Felz was drunk, Bruce knowing this and letting the man drive home would look bad for not only Bruce Whitaker, but could implicate him in liabilities down the road.

Dan Hughes said City Manager Joe Felz was suspected of consuming alcohol – but wasn’t impaired – prior to being involved in single-vehicle crash early Wednesday, according to a memo from Fullerton Police Chief Dan Hughes.

“On November 9, 2016 at approximately 0130 hours FPD officers were dispatched to 255 W. Glenwood regarding a possible collision where the vehicle had struck a curb and was stuck on the sidewalk. The driver was later determined to be city manager Joe Felz. I received a telephone call at my residence from the Watch Commander who informed me that the city manager was involved in a minor single vehicle collision and that the sergeant believed the city manager was emitting an odor of alcohol. I informed the Watch Commander that I would call the sergeant to obtain additional information and that I would have the field sergeant conduct a preliminary assessment by performing Field Sobriety Tests and if the sergeant believed there was a level of intoxication that met the criteria to be a violation of the law, we would contact the CHP to investigate. I provided the above directions to the field sergeant and also briefly spoke to the city manager on the phone to explain what protocol would be followed. The sergeant conducted the assessment and made the determination that the city manager had consumed alcohol, but did not meet the criteria of 23152(a) CVC. The city manager was driven home and his vehicle was towed. During this time period, I also contacted Mayor Fitzgerald and informed her I was following the protocol of notifying the mayor about the contact with the city manager. I informed the mayor of the directions I had provided to the field sergeant and that I would re-contact her when the investigation was complete. Her only instructions were to follow normal procedures. A collision report was documented under case 2016-74804 and a supplemental report will be completed by the sergeant documenting the assessment of the city manager.”

We know he was consuming alcohol. Bruce admitted it, the officer on the scene smelled it, he crashed his car and gets a free ride home with no charges filed?

I know of people who were given a DUI when their car was already in their driveway, they were on their grass with the keys in their pocket and FPD arrested them. Joe Felz jumps a curb, takes out a tree, smells like booze and gets the royal treatment. That just goes to show how corrupt this city and its leadership is.

Our very own Bruce Whitaker even makes a subjective determination as to his condition at the time they were drinking together and stated  that he was in control of his faculties. What a guy.

Bruce Whitaker needs to stand up now and demand a full investigation of what policies were violated as well as the release of the body cameras and get the department to explain why the breathalyzer tests were not taken not immediately upon arrival at the scene but long after. Nothing short of that is acceptable.

I was disappointed but not surprised that the Planning Committee voted for the 32-unit development by Melia Homes on a scant 3.3 acres.  One committee member had the audacity to state that the traffic in and around the Laguna Road Elementary School was not the developer’s problem (but it most definitely should be the city of Fullerton’s problem along with the Fullerton School District).

By voting for the zoning change the developer is requesting, you are allowing him to make the traffic problems worse.  Therefore, the serious traffic congestion at the beginning and end of each day at Laguna Road School is in fact in part the developer’s problem.   The commissioners are making that property much more valuable to the landowner by voting for the zoning change from office/medical space to attached housing, yet giving him a pass on the added traffic congestion and added parking problems the developer will create for the surrounding neighborhood.   It seems that as commissioners you are not thinking clearly and certainly ignoring the very legitimate concerns of the community.

P.S.  There was not one bit of evidence asked for by the committee or given by Melia Homes that demonstrated that a smaller single-family development was not financially feasible on that 3.3-acre site.  The public did speak to a new single-family development across from Laguna Road School of 7 houses on about 3 acres of land.  That is obviously financially viable but we are to believe the sales BS of Melia Homes that they need a minimum of 32 homes on 3.3 acres to be financially viable, only a short few hundred feet away.   For all the degrees and education represented on this Planning Commission, they sure seem to lack of whole bunch of common sense and objectivity.

Here is the description of the other project from the City of Fullerton.

The project is a residential development that proposes seven single family detached houses on a 2.97 acre lot, with a gross density of 2.57 dwelling units per acre. The lots will range in size from 17,620 square feet to 20,879 square feet. Vehicular access to the houses would be from Laguna Road via gated private drive that would be constructed

The City of Fullerton Government Continues It’s March To Make Its Deals with Specific Special Interests At Both The June 21 Council Meeting And The June 22 Planning Committee Meeting. By Barry Levinson

First before I talk about the 1st two agenda items on the June 21, 2016 council meeting, I must bring to your attention Item No. 2 under Closed Session.   (Item No. 2 – Conference with Real Property Negotiator – Per Government Code Section 54956.8.)  It lists two pieces of property.   One property, Meridian Health Club is located at 1535 Deerpark Drive and the other property is located at 1747 West Commonwealth Ave near the Grace Ministries International Building. The parties besides the city are the Meridian Club and Grace Ministries International.

Why is the city once again in sole source negotiations on two pieces of property?  In order to sell any parcel of property the best way to maximize its market value is to put it up for sale to the public at large.  Similar to the comments by Joe Felz at a recent Library Board meeting, where he recommended we sell the Hunt Library to Grace Ministries with a sole source bid, here we have the same shenanigans by our city.

This building at Grace Ministries in Fullerton looks more like a bank than a church. That’s because that is precisely what it is. MASSIVE AMOUNTS OF MONEY GO IN AND NEVER COME BACK TO THE COMMUNITY JUST LIKE CITY HALL.

This is not in the best financial interest of the people of Fullerton.  Would any council member or Mr. Felz enter into a sole source negotiation to sell their residence or would they put it on the open market to attract the best possible price.  Yes, Mr. Felz or Ms. Fitzgerald can offer there home for a less than market price because it is their house.   The properties in question are not owned by Mr. Felz or Ms. Fitzgerald but are owned by the people of Fullerton.  It is the City Manager’s and the City Council’s fiduciary duty to maximize the sales price for any piece of city property.  To do otherwise would be committing malfeasance in my opinion.

Both Mr. Imbriano and myself talked about this troubling situation.  Mr. Imbriano asked that they agendize a change on how the city sells “excess” city property.  Of course all five council members and our city manager ignored our pleas for fiscal and fiduciary sanity.

Then we go on to the main event, regular business and we have before us an “exclusive negotiating agreement with Pelican Community, Inc. for 12 months with 2 optional 45-day extensions to come up with a concept/basic designs for the Fox Block including a 200 space parking structure and an office building of unknown size and height.  The particulars of the Fox Theatre including how much additional work is required and an estimated reopening date were not provided during the agenda item discussion.  Leland Wilson, the President of the Fullerton Historic Theatre Foundation (FHTF) non-profit group spoke but provided no information on the status of the Fox Theatre Renovation.  Ten years plus and counting and we hear about plans for a parking structure and a major new office building to be built next to the Fox Theatre only.  Please go to the FHTF website at www.fullertonfox.org to see how little information there is about the status and future of the Fox Theatre in Fullerton.

There is one more point I need to make concerning this exclusive agreement.  Mr. Hamm the owner of Pelican Properties, Inc. stated that he thought an office building should be a major part of his concept for the Fox Block.  Yet at the Planning Committee meeting recently the city staff and some commissioners such as Larry Bennett where stating that the reason they want to change the zoning of the property on Bastanchury, formerly the Fullerton Internal Medicine Clinic to townhomes is because there is no demand for office space in Fullerton.   So on the one hand the city argues to change zoning from office/medical space because of lack of demand for an office/medical building but a mile south on Harbor and Chapman, we entered into an exclusive arrangement with one developer to build us more office space.  Either there is or is not demand for office space in Fullerton.

Council Agenda Item No. 2 is no better.   City of Fullerton puts on the ballet the right to open up to 9 marijuana dispensaries along with the legalization of the commercial manufacture and distribution in our city.  Of course the city wants this to make money as it requests a whopping 15% tax with the ability to raise it to 20%.  It is not enough that a previous council has destroyed our once family oriented downtown with numerous bars and nightclubs that every weekend attracts thousands of people throughout Southern California including some undesirable types.

One city study estimated it costs the taxpayers a net 1 million dollars a year for this financial and social fiasco.  I spoke of these past follies by our city government and asked them not to place this measure on our November ballet.  Mayor Fitzgerald got cold feet and quickly made a motion to continue this item until after the election.  The staff’s presentation ignored the health and moral concerns of making pot legally readily available in Fullerton.  I suspect that Ms. Haluza was directed by her boss to ignore the moral and health implications of this issue.  If that was the case, what does that tell you about our City Manager, Joe Felz?

There is another very important point that I must make concerning this agenda item.  Question:  If legalizing the sale and manufacture of marijuana in Fullerton is such a good idea, then why all the restrictions on both the placement and number of establishments? Why is it   necessary to place a 15% tax on marijuana sales with the city option to raise it to 20%?

It seems that once again it is all about generating additional tax revenue to make up the huge shortfall created by our city council and their very generous raises to police 6% a year and fire 9% over two years.   It is kind of funny/ironic to think that the city wanted to bring marijuana to Fullerton to help pay for the very generous police raises.  These things can only happen in Fullerton. felza-150x150Question: Why did Joe Felz and Mayor Fitzgerald bring this very controversial and unnecessary agenda item forward at this time, if it had zero support?  (The final vote was 5 to 0 to continue the item until after the November elections.  I believe Mayor Fitzgerald had the authority to keep this from being on the agenda.  Obviously, this was a trial balloon by Felz and Fitzgerald, which they originally hoped would pass but got cold feet when they saw the amount of opposition.
