An Advocacy and Guide for Autistic and Special Needs Families Challenged with Legal and CPS Issues.

My son, Justice, was diagnosed at the age of 6 with Asperger’s syndrome.  The horrific journey we have been on since the time he could walk is what inspired me to research autism, as well our medical, social, and legal systems that were not prepared, nor equipped to handle the epidemic that is sweeping across our nation.

This book is written to create awareness of the changes required in America due to the rapid epidemic growth of autism in the United States. The number of children diagnosed with it has grown from 1 in 2,220 in the 1970s to our present day overload of 1 in 68, with a 5 to 1 boy girl ratio.1 Researchers state this rapid growth has to be environmental rather than genetic. There are probably a myriad reasons for this explosive growth. We are in a chemical and electrical matrix unknown before to humanity. The chemical toxins of the 20th century combined with the electromagnetic radiations of the 21st century have led to unknown influences on the brains’ of our children. This assault has been unprecedented in human history. Since we are chemical and electrical beings, it makes sense we are being impacted by this whole new unprecedented environment.

Our guidelines or guideposts that worked before the chemical and electrical age have to drop away for they do not work with the new brains that are continually being created. The projections are that by 2030, one half of all children born in the U.S. will be autistic. At this rate, autistic families are not in the majority yet, but soon will be. Eventually everyone will be impacted and our social system must be changed to assist the ever increasing number of families so they do not suffer annihilation disintegration as our present system results in due to children acting in ways never seen before; therefore our current systems are woefully inadequate and are not able to assist the children to become functioning adults, as our society will require with such large numbers adding to our population yearly.

There can be no gain in just saying that governmental and judicial injustices’ engulf this country. Riverside County, California is one of the highest in national statistics for Child Protective Services (CPS) fraud and corruption. It has earned an ugly record of devastating innocent families for federal bonus money and political gain, with no regard as to how it destroys and scars the souls of countless children, their parents, and their grandparents. Its unjust treatment of parents and their priceless children in the courts is a notorious reality. It is not just Riverside County, however, this is happening in every section of our country. I have discovered in my in-depth research that there have been more cases of abuse, molestation, and murder of children while in the foster care system than by the natural parents, or guardians. I have also uncovered that 60% of CPS cases are fraudulent like my family’s case, which has been going on for two years now. The remaining 40% of CPS cases are actual dangerous situations; but often those children get to go home, and are put right back into harm’s way. Meanwhile, innocent families are deprived of their children, resulting in the tragic outcome of their never seeing their parents again. These are the hard, brutal, and unbelievable facts. On the basis of these conditions I have sought knowledge on all aspects of this repetitive miscarriage of justice. Caseworkers, attorneys, and judges consistently refuse to engage in good faith negotiation in order to arrive at the goal of a “reasonable effort” to reunify the whole family.

Another huge concern is, even after you are fortunate enough to get your children home, the emotional duress and psychological harm created in children ripped from their parents’ arms, and transferred from foster family to foster family can result in scars that may take years to heal, if they are ever capable of healing at all. The social service system as it has been created and grown into such powerful proportions is completely responsible for these scars, yet their misconduct goes unrecognized as a problem. We are victims of broken promises we have been forced to endure. Our family has been at odds with CPS for the past eight years due to our oldest son, who has had frequent violent meltdowns and was finally diagnosed with Asperger’s syndrome at the age of six. From the time he could walk he has been difficult to handle. This escalated as his two younger brothers came into the family. The constant intervention, which became necessary to protect the younger boys from his anger, only fueled his tantrums. But, we were doing it, chugging along one day at a time, providing a safe and loving environment for our three sons.

We believed that the CPS system would help us as they assured they would. Over the years, as the weeks and months of Justices’ out-of-control behavior and constant lying to the school continued, we only slowly realized that we were the innocent victims of CPS corruption that spans this country nationwide. Not only had our family been ripped apart, our hopes were ripped apart, and the dark shadow of a deep disappointment settled upon us. Eventually, in an effort to protect our children from continued loss of family reunification and being transferred from foster home to foster home, we started researching on how to take direct action to be heard. I have spent the last several months reading case after case, just in the state of California alone, that are eerily similar to our own case. We thought we had the right to present our defense; and attempted to assert our fundamental rights that are protected under the United States constitution. We learned, however, we had to present our defense more aggressively, and attempted to lay our case before the conscience of the local, and national community. We were not unmindful of the difficulties involved. We thought this was the best way to apply pressure on the attorneys, caseworkers, even the judge, for the much needed turn around on our case for the charges to be dropped or expunged, since our son is one of the 1,000s of emerging unique cases that current laws were not written for and do not accommodate, nor even recognize autistic behavior.

When we kept losing ground, rather than gaining it, I conducted more research and came across the grizzly discovery that our judge has been repeatedly connected with many other parents who have had their children ripped from them. There are so many an entire website has been established to help parents fight the corruption of CPS.

Nonviolent direct action seeks to establish the creative tension that a community that has consistently deprived us of its rights needs to confront the issue. It is toward this goal that I have created this expose, seeking to bring attention to the issues that can no longer be ignored.

The creation of tension is part of the work of being a mother; and now I am utilizing it in my attempting to assert my parental rights, and protect my children from further CPS abuse. I am not afraid of the word tension. I have earnestly worked, and lived with violent tension since my son was 2 years old. There is another type of constructive nonviolent tension that is necessary for growth. Just as Socrates felt that it was necessary to create a tension in the mind so that individuals could rise from the bondage of myths and half-truths to the unfettered realm of creative analysis and objective appraisal, we must see the need of having whistleblowers, and trailblazers to create the kind of tension in society that will help people to rise from the dark depths of governmental and CPS corruption to the majestic heights of understanding. My urgent need to write this book is an attempt to create the atmosphere that it will inevitably open the door to a complete reformation of Child Protective Services, so that it will truly be protective rather than destructive as it is now to too many families.

Too long has our beloved country been bogged down in the tragic attempt to live in monologue, rather than dialogue. We will be sadly mistaken if we think that the election of a few good-will leaders will bring the much needed CPS reform to our nation. While some political leaders are more articulate, and gentle than others, the majority are dedicated to the task of maintaining the status quo. This is not in the “best interest of the child.” The CPS status quo at present is to be bought and sold, institutionalized, over medicated, and brainwashed; instead of being in their own home where they belong in the loving arms of their natural parents.

Reinhold Niebuhr tells us that groups are more immoral than individuals. Individuals may see the moral light and voluntarily give up their unjust posture. We have not made a single gain in civil rights without determined legal, and nonviolent pressure from the devotees of civil rights. History is the long, and tragic saga of the fact that privileged groups seldom give up their privileges voluntarily. We know through painful experiences that freedom is never voluntarily given by the oppressor; it must be demanded by the oppressed. The hope I have in our political leaders is that they will be reasonable enough to see the futility of not listening to the massive resistance that is arising across the nation to resist this deconstruction of our families, and therefore our country. I trust the information outlined in this book will start the progress that is necessary for the American family to become the sacred unit with parents guaranteed the freedom to protect and raise their children according to their values, which America’s founders fought for, and carefully created our constitution to ensure that right.

We have waited for more than two years for our constitutional, and God-given rights, to be respected and enforced by our law enforcement officials. I guess it is easy for those who have never felt the stinging results of CPS corruption that has labeled me guilty of “child endangerment” and “corporal punishment”. They provided falsified reports and hearsay, which our judge has embraced as the Biblical truth. An autistic child who has been so extremely uncontrollable that even staffed institutions have had to resort to “chemical restraint” to protect the child and the other children in the home has resulted in our entire family being torn apart. They themselves have told us he is the most difficult child they have ever worked with. The result of the lack of understanding the difficulties involved in attempting to protect an autistic child from harming himself and his brothers has led to this family becoming homeless, bankrupt, and branded as felonous. I hope to create changes by taking society on the journey this family of five have been subjected to, which is an example of what 1,000s of families are facing today. When you have walked through the dungeon doors of blatant judicial corruption; and you have seen hate filled policemen curse at, kick and brutalize myself and my family with impunity; when you see the multiple numbers of parents struggling with the challenges that come along with autism; when you suddenly find your tongue twisted and your speech stammering as you seek to explain to your 4 year old son why he can’t come home with you, and see tears welling up in his little eyes when he is told you are not allowed to come home yet; we do not know when, or even if they are coming home. I see the depressing clouds of inferiority begin to form in his little mental sky, and see him begin to distort his little personality by unconsciously developing a bitterness toward any authority, or adult who continues to hinder him from going home; when you have to concoct an answer for your 10 year old son, asking in agonizing pathos; “Mommy why do my foster parents treat us so mean?” When our whole family was rendered into financial ruin in a vane attempt to get our boys home as we lost our home, jobs, car, everything we worked hard for, for over 16 years—just gone—forcing the necessity to sleep night after night in the uncomfortable corners of your automobile because you have been bankrupt by your county. When you are humiliated day in and day out by the false, unjust labeling of a convicted felon. When no one in the courtroom addresses me with the respected title of “Mrs.”; when you are harassed by day; and haunted by night with ruminating thoughts about your entire family’s annihilation. Living constantly at a tip-toe stance, never quite knowing what to expect next, and plagued with inner fears and outer resentments; when you are forever fighting a degenerating sense of “nobodyness”; then you will understand why we find it difficult to wait patiently for the justice that must be brought to families with special needs children.

There comes a time when the cup of endurance runs over, and we as parents are no longer willing to be plunged into an abyss of injustice, where we experience the bleakness of corroding despair. I hope my dear readers can understand our legitimate, and unavoidable impatience. Riverside County workers express a great deal of anxiety over our willingness to break laws. This is certainly a legitimate concern if we were in fact the horrible monster parents CPS has diligently made us out to be in all the court documents and reports. Due to the new challenges and difficulties of working with children whose biochemistry is not “normal”, it is impossible to place the traditional “normal” expectations on the behavior of the parents, as well as the child. Since autistic children are unique, there are no established guidelines with which to judge “normal”, and CPS workers are left with no foundation with which to judge parents, resulting in their inability to see what is best for the family. They end up taking the truth, chewing it up, misconstruing all of it, and spitting it out in a vicious, and accusatory way. Our family is in no way the picture they have painted, nor that they have painted of others throughout the country. We have a violent and autistic son. Other than that we are a very caring, and loving family. We have a lot of good memories to keep our minds and hearts in some degree of peace.

The fact is there are two types of laws; there are just, and there are unjust laws. I would agree with Saint Augustine that “An unjust law is no law at all”. A just law is a man-made code that is in harmony with the moral law. To put it into the terms of Saint Thomas Aquinas, an unjust law is a human law that is not rooted in eternal and natural law. Any law that uplifts human personality is just. Any law that degrades human personality is unjust. The system set up by social services before the autism epidemic was not designed to work with “non-normal” families. By not recognizing and changing to cope with out-of-control children, the CPS system now tears entire innocent families apart; the charges distort the soul, and damage the personalities of the young children who are involved. It gives these vicious accusers a false sense of superiority, and the families a false sense of inferiority.

To use the words of Martin Buber, the great Jewish philosopher, legal abuse substitutes an “I-it” relationship for the “I-thou” relationship, and ends up relegating people to the status of “things”. To them people are dispensable. The abuse of power is not only politically, economically, and sociologically unsound; it is morally wrong and sinful. Paul Tillich has said that sin is separation. I think depriving families of their fundamental rights protected under the United States Constitution is an existential expression of our tragic separation.

Throughout our country all types of conniving methods are used to prevent family reunification for the sole purpose of monetary gain. CPS is bound to abide by their own welfare institution code that demands them to make every “reasonable effort” for family reunification. However, Justice was transferred from foster home to foster home. My now love-starved autistic son was institutionalized because two foster families could not physically handle his violent behavior. But, I was able to. It was a daily battle, so I just focused on his good moments. My motherly instincts are more important for my son’s best interest, not an institution that over medicates him, rather than works with him, like we as a family were doing on a consistent basis. This is Child Protective Services’ s idea of preventing child abuse, by obviously inflicting abuse on my child, and depriving him of his loving family. That is a text book example of causing my child to suffer from “parental alienation syndrome” at its worst.

We can never forget that everything Hitler did in Germany was “legal” and everything the Hungarian Freedom Fighters did in Hungary was “illegal”! It was “illegal” to aid and comfort a Jew in Hitler’s Germany. But, I am sure that if I had lived in Germany during that time I would have aided and comforted my Jewish brothers even though it was illegal. If I lived in a communist country today where certain principals dear to my personal faith are suppressed, I believe I would openly advocate disobeying these anti-religious laws.

Over the last few years I have been gravely disappointed with our law enforcement and judicial system. I have reached the regrettable conclusion that the citizen’s great stumbling block in the stride towards judicial freedom rests solely on the corrupt court officials who are more devoted to “order” than to justice. I had hoped that the judicial system would understand that law and order exist for the purpose of establishing justice, and that when they fail to do this they become the dangerously structured dams that block the flow of social progress, which forces parents to passively accept their unjust plight. We must press for a substance-filled positive peace, where all people will respect the dignity and worth of human personality. Those of us who engage in nonviolent, direct action are not the creators of tension. We merely bring to the surface the hidden tension that is already alive. We bring it out into the open where it can be seen and dealt with. Injustice must be exposed, with all of the tension its exposing creates, to the light of human conscience and the air of national opinion. Only then will this disease be cured.

There is a strange irrational notion that there is something in the very flow of time that will inevitably cure all the diseases in our government and judicial system. Actually, time is neutral. It can be used destructively or constructively. I am coming to feel that the people of ill will have used time much more effectively than the people of good will. We will have to repent in this generation not merely for vitriolic words and actions of the bad people, but for the appalling silence of the good people. We must come to see that human progress never rolls in on wheels of inevitability. It comes through the tireless efforts, and persistent work of the people willing to be co-workers with God. Without this hard work, time itself becomes an ally of the forces of social stagnation. We must use time creatively, and forever realize that the time is always ripe to do right. Now is the time to make real the promise of our founding fathers, and transform our national chaos into a creative psalm of justice. Now is the time to lift our national policies from the quicksand of judicial injustice to the solid rock of human dignity.

I started thinking about the fact that I stand in the middle of three opposing forces with Riverside County. One is a force of complacency, made up of heart-broken parents, and children whom, as a result of enduring years of oppression, have been so completely drained of self-respect, and a sense of “somebodyness” that they have adjusted to the corruption and injustice. Second is a select small group of workers, in the middle class who because of a degree of academic and economic security, and because they profit by removing adoptable children from their loving homes, have unconsciously become insensitive to the problems of the new growing minority of special needs families. The third force is one of bitterness and hatred that is becoming perilously close to advocating violence. This is expressed in various venues on the Internet, nourished by the contemporary frustration over the continued existence of CPS corruption and abuse. It is made up of parents and grandparents who have lost faith in America, who have absolutely repudiated the juvenile judicial system; and who have concluded that the system is an incurable “devil”.

I want to stand between these three forces and make a difference. We do not need to follow the “do-nothingness” of the complacent, or the hatred and despair suffered by the innocent families. There is a better way of handling it—with love and nonviolent protest. This philosophy will take shape and emerge victorious on the road to justice.

Oppressed people cannot remain suppressed forever. The urge for freedom will eventually come. Something within us drives each of us to assert our birthright of freedom; living without it sparks an urgent need to gain it back, consciously and unconsciously. I have been swept in by what the Germans call zeitgeist (spirit of time). I am moving with a sense of cosmic urgency toward the promise land of justice for all, recognizing this vital urge to right the wrongs at public demonstrations. All the heartbroken families have pent up resentments and latent frustrations. We have to get them out. So let us march sometimes; let us have prayer pilgrimages to the city hall; understand why we must have sit-ins and freedom rides. If these repressed emotions do not come out in various nonviolent ways, they will come out in ominous expressions of violence. This is not a threat; it is a fact of history.

On Calvary’s hill three men were crucified. We must not forget that all three men were crucified for the same crime, the crime of extremism. Two extremists for immorality, and thusly fell below their environment. The other Jesus Christ was an extremist for love, truth, and goodness, and thereby rose above his environment. I believe our nation and the world are in dire need of creative extremists.

There are not enough representatives within our power structure that can understand, nor appreciate the deep groans and passionate yearnings of those that have been maliciously abused by the system; and even fewer have the vision to see that injustice must be rooted out by strong, persistent, and determined action. Some have grasped the understanding of our undeniable social decay, and have committed themselves to changing it. They are still all too small in quantity, but they are big in quality. They have recognized the urgency of the moment, and sense the need for powerful antidotes that will combat the disease of governmental corruption.

In spite of my shattered dreams of the past, I have come to realize that writing this book is my purpose here in life. I must take a stand to put a stop to the judicial genocide causing innocent families to be torn apart, like my own family at the deceptive hands of our corrupt system. Having researched for eight years and uncovering all this data, my blood, sweat, and tears are within every page. My goal is to strengthen our society by sharing my story and knowledge to anyone who demands justice. The deconstruction of families and communities must come to an end. Our children are our future. The state and government should not infringe upon the sacred familial bonds that are protected under the fourteenth amendment of our U.S. constitution. Our constitutional rights are repeatedly violated by law enforcement officers and corrupt courtrooms; with total deprivation of our rights. Our founding fathers wrote the Constitution of the United States to protect the people from the government, not to protect the government from the people.

I wish I had all this information eight years ago when our journey into this nightmare began. This all could have been prevented. I hope, and pray this book will prevent the traumatic chaos we have endured, and help other families that have fallen victim to legal abuse, and legal kidnapping by the very people that are supposed to protect and preserve sacred familial bonds to obtain justice.

Let us all hope that the dark clouds of autism and CPS corruption will soon pass away, and the deep fog of misunderstanding will be lifted from our fear-drenched communities. Hopefully, in some not so distant future—justice will prevail.

Risks and challenges

The information that I will be divulging within the pages of my book will not be favored by the elected officials that value money more than human life.

Some of the content in my book is from the investigation that the late Senator Nancy Schaefer of the 50th district in Georgia presented to congress. Sadly a few days before she was planning on presenting the grizzly evidence of a corrupt CPS to the world court with the motion to scrap CPS completely, and have local law enforcement handle allegations of abuse, she and her husband were found shot in their home. I want to carry on what she started. I am more than willing to put myself out there. The needless suffering of children and their families must, and will come to an end. I will spend my last breath fighting for what is right.

    Calling for a Medical Kidnapping Smackdown

    Many of you have been following the ongoing medical kidnapping attempt of a seven-year-old little girl named Kennedy Willey at Children’s Hospital of Orange County, California. There is a whole back-story on how she came to have seizures as a toddler and I don’t want to spoil it for you but I’ll give you three guesses as to the trigger (hint: rhymes with schmaxseens).     I have known Kennedy’s mother, Dawn, for a couple of years now and I met her whole family earlier this year on my way through Southern California. Kennedy’s parents are two of my favorite parents of all-time. They are mother-effing warriors, I tell you. We should all aspire to be so strong.

    They have worked very hard to manage their daughter’s seizure disorder without pharmaceutical drugs (which were failing her) by providing her with the healthiest, most nutritious foods available. They have left their home state to allow Kennedy to live on the water where allergy pollen is low and life is peaceful. Kennedy has blown away every statistic ever known about her seizure disorder and she is a model patient in how to manage it. She is smart, she is funny, she is active and she is normal. You would never know when you meet her that she has a debilitating disease.

    A few weeks ago Kennedy’s seizures began to return and by April 18th she was having multiple grand mals a day. Her parents had no choice but to take her to their local ER on April 23rd when they could not bring the seizures under control. The ER transferred Kennedy to Children’s Hospital of Orange County for admission. Dawn was horrified since she’d heard the nightmare stories about their head neurologist, Dr. Zupanc, who claims to be the foremost expert on Kennedy’s seizure disorder.

    Kennedy underwent EEGs, anesthesia and two spinal taps, an MRI, a CT scan, and was loaded with Depakote, Keppra, and Phenobarbitrol. When a dose of Depakote caused Kennedy to suffer an allergic reaction, as Dawn warned the staff it would, the doctor’s order was to give her more. Dawn had to throw her body in between her daughter and the nurses to stop the dosing.

    Kennedy worsened in their care and the seizures were clustering badly, minutes apart, but the doctors continued to load her with meds. Kennedy was starved by the hospital for seven straight days despite their promise to honor her mother’s request for a feeding tube so that Kennedy could metabolize the medication.

    Dr. Zupanc refused to believe that Kennedy had been a happy, healthy, normal child running on the beach and didn’t want to watch her mother’s videos showing it because in her opinion, no “normal” child has Kennedy’s seizure disorder. She said that the GAPS diet that brought so much healing to Kennedy was not proven, and that she, the doctor, knew Kennedy better than her parents.

    On April 26th, after three days of terrifying downward spiral, Dawn asked that Kennedy be at least four hours seizure-free before going back on the EEG. The doctor burst into the room screaming about getting a court order and Kennedy’s dad Carl took the conversation outside. When he returned he said the hospital made the decision to move Kennedy to the ICU. This was the hospital’s first step in starting to treat Kennedy without her parents’ consent.

    Then the neurologist called Child Protective Services.

    At 11pm CPS arrived and interrogated Kennedy’s starving, sleep-deprived, emotionally-wrecked parents for 2 hours. The next morning Dr. Zupanc came into Kennedy’s room with ten other doctors and claimed that Kennedy was having seizures that only the doctor could see, and that she had grounds to increase the drug load. Kennedy was already comatose and wearing a diaper by this point.

    Their little girl was slipping away before their eyes and CPS made it clear that if Dawn and Carl intervened again, they would come back with a court order. Dawn and Carl had no choice but to submit to a second spinal tap.

    Friends, I personally was down on my knees praying for this child by this point. I was sick over them losing her.

    On April 28th Kennedy finally got a feeding tube after starving for seven straight days; a horrific procedure.

    Dawn and Carl began to make moves to get Kennedy out of CHOC while CPS was interviewing their 8-year-old daughter, Reagan, in their home. They hired two attorneys and a 20-year medical advocate. Dr. Zupanc had other plans and the battle went all the way to the chief of the hospital. The medical advocate veteran had never seen a doctor behave in this way before.

    On a conference call, a metabolic doctor told them that a second spinal tap was a dangerous fishing expedition. The ICU pediatrician said that Kennedy was stable enough to be airlifted out. Arrangements were made and the University of California at San Francisco was standing by to receive little Kennedy.

    Carl left to get the transfer papers notarized when the ICU pediatrician informed Dawn that Dr. Zupanc had blocked their transfer by declaring Kennedy unfit to travel. Carl returned and begged the pediatrician to advocate on their behalf and release Kennedy but the doctor was afraid of dealing with the wrath of Dr. Zupanc.

    After hours of negotiating with Carl, the attorneys, and the medical advocate, the pediatrician released Kennedy from the hospital. When UCSF called to finalize the transfer, Dr. Zupanc got on a recorded line and stated that Kennedy was not approved for travel by her or her colleagues. Confused, UCSF called Carl, who promptly got the ICU pediatrician on the phone, and confirmed that Kennedy was free to leave. Her exit was arranged for the next day, April 29th.

    At 7:30 am they were informed the release was rescheduled for 10 am, and at 8 am technicians came into the room in attempt to re-wire Kennedy to the EEG, on Dr. Zupanc’s orders. Carl had to get the pediatrician to intervene on their behalf. Finally, at 12:15, the team arrived to get Kennedy the hell out of there. She was finally going to be safe in San Francisco.

    Kennedy began to wake from her comatose state as the hours passed without Dr. Zupanc’s drugs. On April 30th she sat up and ate eggs, bacon, yogurt and pears for breakfast.

    The celebration was short-lived as Carl and Dawn discovered that Dr. Zupanc had called CPS in San Francisco. The doctor accused the Willeys of severe medical neglect and refusing all medication.

    Friends, you know what this situation calls for. Kennedy needs your help and obviously this doctor needs a little assistance in getting her mind right. She’s got to call off these dogs.

Call their donors and tell them to stop donating. Call the US Senators for California and tell them that not only did this happen, but it is still happening, and you expect this to stop immediately.

    Medical kidnapping seems like a sensationalist idea until it happens to someone you love. Let’s stop this one in its tracks.
