An Advocacy and Guide for Autistic and Special Needs Families Challenged with Legal and CPS Issues.

My son, Justice, was diagnosed at the age of 6 with Asperger’s syndrome.  The horrific journey we have been on since the time he could walk is what inspired me to research autism, as well our medical, social, and legal systems that were not prepared, nor equipped to handle the epidemic that is sweeping across our nation.

This book is written to create awareness of the changes required in America due to the rapid epidemic growth of autism in the United States. The number of children diagnosed with it has grown from 1 in 2,220 in the 1970s to our present day overload of 1 in 68, with a 5 to 1 boy girl ratio.1 Researchers state this rapid growth has to be environmental rather than genetic. There are probably a myriad reasons for this explosive growth. We are in a chemical and electrical matrix unknown before to humanity. The chemical toxins of the 20th century combined with the electromagnetic radiations of the 21st century have led to unknown influences on the brains’ of our children. This assault has been unprecedented in human history. Since we are chemical and electrical beings, it makes sense we are being impacted by this whole new unprecedented environment.

Our guidelines or guideposts that worked before the chemical and electrical age have to drop away for they do not work with the new brains that are continually being created. The projections are that by 2030, one half of all children born in the U.S. will be autistic. At this rate, autistic families are not in the majority yet, but soon will be. Eventually everyone will be impacted and our social system must be changed to assist the ever increasing number of families so they do not suffer annihilation disintegration as our present system results in due to children acting in ways never seen before; therefore our current systems are woefully inadequate and are not able to assist the children to become functioning adults, as our society will require with such large numbers adding to our population yearly.

There can be no gain in just saying that governmental and judicial injustices’ engulf this country. Riverside County, California is one of the highest in national statistics for Child Protective Services (CPS) fraud and corruption. It has earned an ugly record of devastating innocent families for federal bonus money and political gain, with no regard as to how it destroys and scars the souls of countless children, their parents, and their grandparents. Its unjust treatment of parents and their priceless children in the courts is a notorious reality. It is not just Riverside County, however, this is happening in every section of our country. I have discovered in my in-depth research that there have been more cases of abuse, molestation, and murder of children while in the foster care system than by the natural parents, or guardians. I have also uncovered that 60% of CPS cases are fraudulent like my family’s case, which has been going on for two years now. The remaining 40% of CPS cases are actual dangerous situations; but often those children get to go home, and are put right back into harm’s way. Meanwhile, innocent families are deprived of their children, resulting in the tragic outcome of their never seeing their parents again. These are the hard, brutal, and unbelievable facts. On the basis of these conditions I have sought knowledge on all aspects of this repetitive miscarriage of justice. Caseworkers, attorneys, and judges consistently refuse to engage in good faith negotiation in order to arrive at the goal of a “reasonable effort” to reunify the whole family.

Another huge concern is, even after you are fortunate enough to get your children home, the emotional duress and psychological harm created in children ripped from their parents’ arms, and transferred from foster family to foster family can result in scars that may take years to heal, if they are ever capable of healing at all. The social service system as it has been created and grown into such powerful proportions is completely responsible for these scars, yet their misconduct goes unrecognized as a problem. We are victims of broken promises we have been forced to endure. Our family has been at odds with CPS for the past eight years due to our oldest son, who has had frequent violent meltdowns and was finally diagnosed with Asperger’s syndrome at the age of six. From the time he could walk he has been difficult to handle. This escalated as his two younger brothers came into the family. The constant intervention, which became necessary to protect the younger boys from his anger, only fueled his tantrums. But, we were doing it, chugging along one day at a time, providing a safe and loving environment for our three sons.

We believed that the CPS system would help us as they assured they would. Over the years, as the weeks and months of Justices’ out-of-control behavior and constant lying to the school continued, we only slowly realized that we were the innocent victims of CPS corruption that spans this country nationwide. Not only had our family been ripped apart, our hopes were ripped apart, and the dark shadow of a deep disappointment settled upon us. Eventually, in an effort to protect our children from continued loss of family reunification and being transferred from foster home to foster home, we started researching on how to take direct action to be heard. I have spent the last several months reading case after case, just in the state of California alone, that are eerily similar to our own case. We thought we had the right to present our defense; and attempted to assert our fundamental rights that are protected under the United States constitution. We learned, however, we had to present our defense more aggressively, and attempted to lay our case before the conscience of the local, and national community. We were not unmindful of the difficulties involved. We thought this was the best way to apply pressure on the attorneys, caseworkers, even the judge, for the much needed turn around on our case for the charges to be dropped or expunged, since our son is one of the 1,000s of emerging unique cases that current laws were not written for and do not accommodate, nor even recognize autistic behavior.

When we kept losing ground, rather than gaining it, I conducted more research and came across the grizzly discovery that our judge has been repeatedly connected with many other parents who have had their children ripped from them. There are so many an entire website has been established to help parents fight the corruption of CPS.

Nonviolent direct action seeks to establish the creative tension that a community that has consistently deprived us of its rights needs to confront the issue. It is toward this goal that I have created this expose, seeking to bring attention to the issues that can no longer be ignored.

The creation of tension is part of the work of being a mother; and now I am utilizing it in my attempting to assert my parental rights, and protect my children from further CPS abuse. I am not afraid of the word tension. I have earnestly worked, and lived with violent tension since my son was 2 years old. There is another type of constructive nonviolent tension that is necessary for growth. Just as Socrates felt that it was necessary to create a tension in the mind so that individuals could rise from the bondage of myths and half-truths to the unfettered realm of creative analysis and objective appraisal, we must see the need of having whistleblowers, and trailblazers to create the kind of tension in society that will help people to rise from the dark depths of governmental and CPS corruption to the majestic heights of understanding. My urgent need to write this book is an attempt to create the atmosphere that it will inevitably open the door to a complete reformation of Child Protective Services, so that it will truly be protective rather than destructive as it is now to too many families.

Too long has our beloved country been bogged down in the tragic attempt to live in monologue, rather than dialogue. We will be sadly mistaken if we think that the election of a few good-will leaders will bring the much needed CPS reform to our nation. While some political leaders are more articulate, and gentle than others, the majority are dedicated to the task of maintaining the status quo. This is not in the “best interest of the child.” The CPS status quo at present is to be bought and sold, institutionalized, over medicated, and brainwashed; instead of being in their own home where they belong in the loving arms of their natural parents.

Reinhold Niebuhr tells us that groups are more immoral than individuals. Individuals may see the moral light and voluntarily give up their unjust posture. We have not made a single gain in civil rights without determined legal, and nonviolent pressure from the devotees of civil rights. History is the long, and tragic saga of the fact that privileged groups seldom give up their privileges voluntarily. We know through painful experiences that freedom is never voluntarily given by the oppressor; it must be demanded by the oppressed. The hope I have in our political leaders is that they will be reasonable enough to see the futility of not listening to the massive resistance that is arising across the nation to resist this deconstruction of our families, and therefore our country. I trust the information outlined in this book will start the progress that is necessary for the American family to become the sacred unit with parents guaranteed the freedom to protect and raise their children according to their values, which America’s founders fought for, and carefully created our constitution to ensure that right.

We have waited for more than two years for our constitutional, and God-given rights, to be respected and enforced by our law enforcement officials. I guess it is easy for those who have never felt the stinging results of CPS corruption that has labeled me guilty of “child endangerment” and “corporal punishment”. They provided falsified reports and hearsay, which our judge has embraced as the Biblical truth. An autistic child who has been so extremely uncontrollable that even staffed institutions have had to resort to “chemical restraint” to protect the child and the other children in the home has resulted in our entire family being torn apart. They themselves have told us he is the most difficult child they have ever worked with. The result of the lack of understanding the difficulties involved in attempting to protect an autistic child from harming himself and his brothers has led to this family becoming homeless, bankrupt, and branded as felonous. I hope to create changes by taking society on the journey this family of five have been subjected to, which is an example of what 1,000s of families are facing today. When you have walked through the dungeon doors of blatant judicial corruption; and you have seen hate filled policemen curse at, kick and brutalize myself and my family with impunity; when you see the multiple numbers of parents struggling with the challenges that come along with autism; when you suddenly find your tongue twisted and your speech stammering as you seek to explain to your 4 year old son why he can’t come home with you, and see tears welling up in his little eyes when he is told you are not allowed to come home yet; we do not know when, or even if they are coming home. I see the depressing clouds of inferiority begin to form in his little mental sky, and see him begin to distort his little personality by unconsciously developing a bitterness toward any authority, or adult who continues to hinder him from going home; when you have to concoct an answer for your 10 year old son, asking in agonizing pathos; “Mommy why do my foster parents treat us so mean?” When our whole family was rendered into financial ruin in a vane attempt to get our boys home as we lost our home, jobs, car, everything we worked hard for, for over 16 years—just gone—forcing the necessity to sleep night after night in the uncomfortable corners of your automobile because you have been bankrupt by your county. When you are humiliated day in and day out by the false, unjust labeling of a convicted felon. When no one in the courtroom addresses me with the respected title of “Mrs.”; when you are harassed by day; and haunted by night with ruminating thoughts about your entire family’s annihilation. Living constantly at a tip-toe stance, never quite knowing what to expect next, and plagued with inner fears and outer resentments; when you are forever fighting a degenerating sense of “nobodyness”; then you will understand why we find it difficult to wait patiently for the justice that must be brought to families with special needs children.

There comes a time when the cup of endurance runs over, and we as parents are no longer willing to be plunged into an abyss of injustice, where we experience the bleakness of corroding despair. I hope my dear readers can understand our legitimate, and unavoidable impatience. Riverside County workers express a great deal of anxiety over our willingness to break laws. This is certainly a legitimate concern if we were in fact the horrible monster parents CPS has diligently made us out to be in all the court documents and reports. Due to the new challenges and difficulties of working with children whose biochemistry is not “normal”, it is impossible to place the traditional “normal” expectations on the behavior of the parents, as well as the child. Since autistic children are unique, there are no established guidelines with which to judge “normal”, and CPS workers are left with no foundation with which to judge parents, resulting in their inability to see what is best for the family. They end up taking the truth, chewing it up, misconstruing all of it, and spitting it out in a vicious, and accusatory way. Our family is in no way the picture they have painted, nor that they have painted of others throughout the country. We have a violent and autistic son. Other than that we are a very caring, and loving family. We have a lot of good memories to keep our minds and hearts in some degree of peace.

The fact is there are two types of laws; there are just, and there are unjust laws. I would agree with Saint Augustine that “An unjust law is no law at all”. A just law is a man-made code that is in harmony with the moral law. To put it into the terms of Saint Thomas Aquinas, an unjust law is a human law that is not rooted in eternal and natural law. Any law that uplifts human personality is just. Any law that degrades human personality is unjust. The system set up by social services before the autism epidemic was not designed to work with “non-normal” families. By not recognizing and changing to cope with out-of-control children, the CPS system now tears entire innocent families apart; the charges distort the soul, and damage the personalities of the young children who are involved. It gives these vicious accusers a false sense of superiority, and the families a false sense of inferiority.

To use the words of Martin Buber, the great Jewish philosopher, legal abuse substitutes an “I-it” relationship for the “I-thou” relationship, and ends up relegating people to the status of “things”. To them people are dispensable. The abuse of power is not only politically, economically, and sociologically unsound; it is morally wrong and sinful. Paul Tillich has said that sin is separation. I think depriving families of their fundamental rights protected under the United States Constitution is an existential expression of our tragic separation.

Throughout our country all types of conniving methods are used to prevent family reunification for the sole purpose of monetary gain. CPS is bound to abide by their own welfare institution code that demands them to make every “reasonable effort” for family reunification. However, Justice was transferred from foster home to foster home. My now love-starved autistic son was institutionalized because two foster families could not physically handle his violent behavior. But, I was able to. It was a daily battle, so I just focused on his good moments. My motherly instincts are more important for my son’s best interest, not an institution that over medicates him, rather than works with him, like we as a family were doing on a consistent basis. This is Child Protective Services’ s idea of preventing child abuse, by obviously inflicting abuse on my child, and depriving him of his loving family. That is a text book example of causing my child to suffer from “parental alienation syndrome” at its worst.

We can never forget that everything Hitler did in Germany was “legal” and everything the Hungarian Freedom Fighters did in Hungary was “illegal”! It was “illegal” to aid and comfort a Jew in Hitler’s Germany. But, I am sure that if I had lived in Germany during that time I would have aided and comforted my Jewish brothers even though it was illegal. If I lived in a communist country today where certain principals dear to my personal faith are suppressed, I believe I would openly advocate disobeying these anti-religious laws.

Over the last few years I have been gravely disappointed with our law enforcement and judicial system. I have reached the regrettable conclusion that the citizen’s great stumbling block in the stride towards judicial freedom rests solely on the corrupt court officials who are more devoted to “order” than to justice. I had hoped that the judicial system would understand that law and order exist for the purpose of establishing justice, and that when they fail to do this they become the dangerously structured dams that block the flow of social progress, which forces parents to passively accept their unjust plight. We must press for a substance-filled positive peace, where all people will respect the dignity and worth of human personality. Those of us who engage in nonviolent, direct action are not the creators of tension. We merely bring to the surface the hidden tension that is already alive. We bring it out into the open where it can be seen and dealt with. Injustice must be exposed, with all of the tension its exposing creates, to the light of human conscience and the air of national opinion. Only then will this disease be cured.

There is a strange irrational notion that there is something in the very flow of time that will inevitably cure all the diseases in our government and judicial system. Actually, time is neutral. It can be used destructively or constructively. I am coming to feel that the people of ill will have used time much more effectively than the people of good will. We will have to repent in this generation not merely for vitriolic words and actions of the bad people, but for the appalling silence of the good people. We must come to see that human progress never rolls in on wheels of inevitability. It comes through the tireless efforts, and persistent work of the people willing to be co-workers with God. Without this hard work, time itself becomes an ally of the forces of social stagnation. We must use time creatively, and forever realize that the time is always ripe to do right. Now is the time to make real the promise of our founding fathers, and transform our national chaos into a creative psalm of justice. Now is the time to lift our national policies from the quicksand of judicial injustice to the solid rock of human dignity.

I started thinking about the fact that I stand in the middle of three opposing forces with Riverside County. One is a force of complacency, made up of heart-broken parents, and children whom, as a result of enduring years of oppression, have been so completely drained of self-respect, and a sense of “somebodyness” that they have adjusted to the corruption and injustice. Second is a select small group of workers, in the middle class who because of a degree of academic and economic security, and because they profit by removing adoptable children from their loving homes, have unconsciously become insensitive to the problems of the new growing minority of special needs families. The third force is one of bitterness and hatred that is becoming perilously close to advocating violence. This is expressed in various venues on the Internet, nourished by the contemporary frustration over the continued existence of CPS corruption and abuse. It is made up of parents and grandparents who have lost faith in America, who have absolutely repudiated the juvenile judicial system; and who have concluded that the system is an incurable “devil”.

I want to stand between these three forces and make a difference. We do not need to follow the “do-nothingness” of the complacent, or the hatred and despair suffered by the innocent families. There is a better way of handling it—with love and nonviolent protest. This philosophy will take shape and emerge victorious on the road to justice.

Oppressed people cannot remain suppressed forever. The urge for freedom will eventually come. Something within us drives each of us to assert our birthright of freedom; living without it sparks an urgent need to gain it back, consciously and unconsciously. I have been swept in by what the Germans call zeitgeist (spirit of time). I am moving with a sense of cosmic urgency toward the promise land of justice for all, recognizing this vital urge to right the wrongs at public demonstrations. All the heartbroken families have pent up resentments and latent frustrations. We have to get them out. So let us march sometimes; let us have prayer pilgrimages to the city hall; understand why we must have sit-ins and freedom rides. If these repressed emotions do not come out in various nonviolent ways, they will come out in ominous expressions of violence. This is not a threat; it is a fact of history.

On Calvary’s hill three men were crucified. We must not forget that all three men were crucified for the same crime, the crime of extremism. Two extremists for immorality, and thusly fell below their environment. The other Jesus Christ was an extremist for love, truth, and goodness, and thereby rose above his environment. I believe our nation and the world are in dire need of creative extremists.

There are not enough representatives within our power structure that can understand, nor appreciate the deep groans and passionate yearnings of those that have been maliciously abused by the system; and even fewer have the vision to see that injustice must be rooted out by strong, persistent, and determined action. Some have grasped the understanding of our undeniable social decay, and have committed themselves to changing it. They are still all too small in quantity, but they are big in quality. They have recognized the urgency of the moment, and sense the need for powerful antidotes that will combat the disease of governmental corruption.

In spite of my shattered dreams of the past, I have come to realize that writing this book is my purpose here in life. I must take a stand to put a stop to the judicial genocide causing innocent families to be torn apart, like my own family at the deceptive hands of our corrupt system. Having researched for eight years and uncovering all this data, my blood, sweat, and tears are within every page. My goal is to strengthen our society by sharing my story and knowledge to anyone who demands justice. The deconstruction of families and communities must come to an end. Our children are our future. The state and government should not infringe upon the sacred familial bonds that are protected under the fourteenth amendment of our U.S. constitution. Our constitutional rights are repeatedly violated by law enforcement officers and corrupt courtrooms; with total deprivation of our rights. Our founding fathers wrote the Constitution of the United States to protect the people from the government, not to protect the government from the people.

I wish I had all this information eight years ago when our journey into this nightmare began. This all could have been prevented. I hope, and pray this book will prevent the traumatic chaos we have endured, and help other families that have fallen victim to legal abuse, and legal kidnapping by the very people that are supposed to protect and preserve sacred familial bonds to obtain justice.

Let us all hope that the dark clouds of autism and CPS corruption will soon pass away, and the deep fog of misunderstanding will be lifted from our fear-drenched communities. Hopefully, in some not so distant future—justice will prevail.

Risks and challenges

The information that I will be divulging within the pages of my book will not be favored by the elected officials that value money more than human life.

Some of the content in my book is from the investigation that the late Senator Nancy Schaefer of the 50th district in Georgia presented to congress. Sadly a few days before she was planning on presenting the grizzly evidence of a corrupt CPS to the world court with the motion to scrap CPS completely, and have local law enforcement handle allegations of abuse, she and her husband were found shot in their home. I want to carry on what she started. I am more than willing to put myself out there. The needless suffering of children and their families must, and will come to an end. I will spend my last breath fighting for what is right.

There has been a lot of discussion about Common Core lately and a growing swell of concerned parents across the country as public schools nationwide begin to apply the Federal standards to curriculums. But what are the facts?

Michelle Malkin has been doing tireless research and reporting on Common Core, and currently has an ongoing series of articles in which she breaks down Common Core into its essential parts. The truth is that there’s more to Common Core than what you might think, and much of it is very alarming.

Part 1 – Common Core’s war on math standards

Stanford University professor James Milgram, the only mathematician on the validation panel, concluded that the Common Core math scheme would place American students two years behind their peers in other high-achieving countries. In protest, Milgram refused to sign off on the standards. He’s not alone.
Professor Jonathan Goodman of New York University found that the Common Core math standards imposed “significantly lower expectations with respect to algebra and geometry than the published standards of other countries.”
Under Common Core, as the American Principles Project and Pioneer Institute point out, algebra I instruction is pushed to 9th grade, instead of 8th grade, as commonly taught. Division is postponed from 5th to 6th grade. Prime factorization, common denominators, conversions of fractions and decimals, and algebraic manipulation are de-emphasized or eschewed. Traditional Euclidean geometry is replaced with an experimental approach that had not been previously pilot-tested in the U.S.

Part 2 – Common Core’s deconstruction of English and literature

Take the Common Core literacy “standards.” Please. As literature professors, writers, humanities scholars, secondary educators and parents have warned over the past three years, the new achievement goals actually set American students back by de-emphasizing great literary works for “informational texts.” Challenging students to digest and dissect difficult poems and novels is becoming passe. Utilitarianism uber alles.
The Common Core English/language arts criteria call for students to spend only half of their class time studying literature, and only 30 percent of their class time by their junior and senior years in high school.

Under Common Core, classics such as “To Kill a Mockingbird” and “The Adventures of Huckleberry Finn” are of no more academic value than the pages of the Federal Register or the Federal Reserve archives — or a pro-Obamacare opinion essay in The New Yorker. Audio and video transcripts, along with “alternative literacies” that are more “relevant” to today’s students (pop song lyrics, for example), are on par with Shakespeare.

English professor Mary Grabar describes Common Core training exercises that tell teachers “to read Lincoln’s Gettysburg Address without emotion and without providing any historical context. Common Core reduces all ‘texts’ to one level: the Gettysburg Address to the EPA’s Recommended Levels of Insulation.” Indeed, in my own research, I found one Common Core “exemplar” on teaching the Gettysburg Address that instructs educators to “refrain from giving background context or substantial instructional guidance at the outset.”

These systems will aggregate massive amounts of personal data — health-care histories, income information, religious affiliations, voting status and even blood types and homework completion. The data will be available to a wide variety of public agencies. And despite federal student-privacy protections guaranteed by the Family Educational Rights and Privacy Act, the Obama administration is paving the way for private entities to buy their way into the data boondoggle. Even more alarming, the U.S. Department of Education is encouraging a radical push from aggregate-level data-gathering to invasive individual student-level data collection.

Part 5 – How to fight Common Core (and how not to)

In my home state of Colorado, dissent from both conservative and liberal parents forced Jefferson County to allow individual “opt-outs” from the inBloom data-mining machine. The Gates Foundation responded by pouring $5 million into the district for “innovative professional development systems to create personalized learning systems for teachers.” How do you spell special interest payoff?
Not only do these education emperors have no clothes. They have tissue-paper thin skin. Their arrogant, contemptuous and vengeful treatment of dissenting parents and teachers gets a world-class “F.”

Listen up:
We parents of school-age children are all Robert Smalls and Natalie Adamses and Leonie Haimsons. We, not the Obamas or the Bushes or the Gateses or educrats in Washington, are our children’s primary educational providers. Control over our children begins and ends with us.

Mr. Makow..for those who knew Bill knew his defiance of the NWO, respected his truthfulness and listened carefully to his words of wisdom.

Shortly before 911 he told of the upcoming event which would occur and lives being lost. Also, spoke of his demise for revealing this information. Shortly after 911 he was murdered.
Let us go back to this event as the press released the ‘on the scene’ story.

Evidently, in the middle of the night ‘they’ came to his property in Eagar, Arizona to arrest him on ‘tax evasion’. Bill reportedly ‘jumped from his porch, hopped up into his truck and began chasing these intruders from his posted property. After reaching the line of his property he retreated back to the house with armed militia following behind. He jumped from the truck and then jumped back onto the porch where an armed conflict took place. A couple of the ‘tax’ men were wounded and Bill was slaughtered.

My question has always been this: How does a one legged man do all this jumping and hopping off porches and trucks? What the press failed to reveal was Bill was left to die after being followed by secret operatives and was fortunately found and taken to a hospital where his leg was amputated.

Mr. Makow, Bill was a true patriot of the meaning of freedom. He was a man with flaws like all humans but he was honest, loved his family, country and had a deep faith in God. His words of truth were his demise.

Many networks wanted to interview Bill and he always refused. It astounded me when I called him for an interview and he granted one. On the day this was to take place I was fired from the little radio station and of course the interview never took place.

High School District Should Vote “No” On Measure I,

a $175,000,000 Bond Issue.

Throughout this year I received three color brochures from the Fullerton Joint Union High School District (FJUHSD).

Each brochure mentioned that they are considering a new bond issue. Finally on
August 5th, the school board voted to place this $175,000,000 25-year
bond on the November 4, 2014 ballot. The added cost to the taxpayer
will be $19 per $100,000 of assessed property value. If your home is
assessed for $500,000, your added tax burden will be $95 per year for
25 years. Taxpayers must remember that the $175,000,000 price tag is
the principal value of the bond. We the taxpayers are on the hook for all
the interest as well, which easily doubles the total cost.

It was irresponsible that the board waited until the very last minute to
make its’ decision to place this bond before the voters. Taxpayers will
be saddled with this increase in property taxes for decades, while the
voters have only three short months to consider this huge bond issue.
What the district will not voluntarily mention is that we the taxpayers
will still be paying off the last FJUHSD bond approved in 2002 for
another 13 years.

The bond will be repaid over a 25-year period. However, the list of
things that the school district wants to use the bond money for are both
long-term and short-term projects. Finance 101 states that it is bad
economic policy to finance short-term projects with long-term money.
For example, a prudent person would not take out a 25-year loan to
finance the purchase of a new computer with a useful life of only 3 or 4
years.

A responsible board would have proposed this bond issue at least 3-6
months earlier in the year. It seems the board purposely waited until
the very last moment to spring this very large bond issue on the public.
A school board more concerned with transparency and openness would not have waited so long.

They still have not provided the public with
the details we will need to make an informed decision. According to one
current board member, the board members themselves have not been
given a specific accounting on how the money will be divided by school
and by project. Good governance requires better, and we the people
demand better from every member of this board and from our
Superintendent.

Do not attempt to adjust the resolution. Seeing things clearly is not my intention.

Under Superintendent’s Bond Resolution Remarks – August 2014,
Superintendent Giokaris states the following, in part:
“Bond financed projects will address facilities needs for repairs,
upgrades, and improvements in the following areas if approved by the
voters.” He goes on to state: “During the economic crisis that began in
2008/2009 and still continues, the District’s operating budget was
reduced by $14 million each year. While we have managed with 11%
fewer dollars to improve our programs and student achievement, there
is no money left to address facilities needs.”

The Superintendent is inferring that much of that $14 million yearly
reduction in the FJUHSD operating budget was taken from facilities,
including the repairs and maintenance the district now wants to
complete with part of the bond proceeds. If I do a little old fashioned
math, you will see that as much as $84 million ($14 million x 6 years)
has been diverted away from facility repair and maintenance. Now the
district wants the taxpayers to bail them out and to help cover up their
poor financial management for the last six years. I say to voters within
the FJUHSD, that we should not reward the district for their poor
decisions. Let the district acknowledge that they made poor choices in
the past and that going forward they will now live within their means.
Please note that the FJUHSD has one of the highest average payrolls of
any school district in Orange County.

There are 13 Bond Money Project Areas that are identified in the
Sample Ballot and Voter Information Pamphlet. For example one project
category is Competitive Athletic Facilities and Physical Education, which
includes to “Renovate/modernize/expand/upgrade existing facilities
district-wide”. Under Gymnasiums it includes painting. Under Sports
fields/tracks it includes all weather tracks, new and/or artificial turf.
Under Baseball/softball fields it includes field/infield renovation, newgrass and/or artificial turf.

None of the items that I have just mentioned
will last 25 years or more. Clearly repairs should have been done on a
regularly scheduled basis as part of a well thought out maintenance
plan. But your tax dollars to repay the new bond issue will be spent on
repairs and maintenance as well as long-term improvements. Why is this
important to bring up to the reader? The simple answer is that while
some of these repairs and maintenance projects will only last 5 or 10
years, we the taxpayer will be paying for it for 25 years. Does that mean
the board will come back again in another 10 years or so to ask for more
tax money to repair these items once again? Why has the district failed
to set aside the proper amount of annual funds to take care of the usual
repair and maintenance items that are very predictable?

The Superintendent states as I mentioned previously that there was a $14
million reduction in the district’s operating budget for the last 6 plus
years. Why hasn’t the district made the proper adjustments to take care
of these repair and maintenance needs of the district during that
time frame? The taxpayers deserve answers to these questions
While the school board is blindly following the new and unproven
Common Core requirements from state bureaucrats with virtually no
parental involvement or consent, the board at the same time wants a
boatload more of our hard-earned tax dollars.

I ask of you, as taxpayers, citizens and parents:

 Does it sound fair that the same school board who is marching in
stride with state-wide bureaucrats to take away our local control of
our schools is asking us to give them hundreds of millions more of
our hard-earned tax dollars?

 Does the fact that they either do not have or have not shared with the
public any detailed accounting of how the money will be spent by
school or by project seem open and transparent?

 Does it make good fiscal sense that they have listed many projects
whose useful life will be long gone a decade or two before we finally
pay for the bond itself?

 Does it make any sense that we the taxpayers should bail out the
district for their poor financial management of the school budgets for
the last six years?

The only logical answer to these questions is “No”.
Vote “No” on Measure I, the $175,000,000 FJUHSD bond issue.

I did not invite Mayor Chaffee to the meeting and I did not ask him to advocate support for the bond.  I know that to do  so is a violation of District and legal guidelines. Attached is the factual information that I passed out and discussed, which is also posted on the District’s Website.  District legal counsel has advised that the attached information is factual and neutral.
If  PTA members are using school facilities and equipment for phone banking, they are doing so in violation of District and legal guidelines.  Phone banking is taking place at private businesses in Brea, Fullerton and La Habra.  If you have any information that phone banking is  taking place at District schools, please let me know immediately so it can be stopped.

By my reading of page 2 of this fact sheet from the California School Boards Association http://www.csba.org/Advocacy/~/media/CSBA/Files/Advocacy/ELA/2011_02_UseOfPublicResourcesForBallotMeasures.ashx, even CSBA interprets using the email list as crossing the line, and CSBA is probably one of the friendliest groups to the idea of school districts sending out school bond literature.

 

On page 1, CSBA notes there are three categories of activities designated by the State Supreme Court regarding public resources on election issues:

  • Permissible informational activities
  • Impermissible campaign activities
  • Unclear activities which require further analysis based on the “style, tenor and timing” of the activity

Even if we generously interpret this document as falling in the “unclear activities” category (if we accept for the sake of argument that the email/attachment never expressly advocates).  However, using the email list just two weeks before the election certainly causes “style, tenor and timing” problems.

A more reasonable interpretation that it’s impermissible campaign activities.  That entire “The Why” section and possibly the last bullet of “District’s Facilities Needs” are express advocacy by my reading.

Under Education Code Section 7054, it appears either the FPPC or the DA could bring an enforcement issue against the district for this.

The strange dichotomy of Dan Hughes

To most Fullerton residents, the names Dan Hughes and Barry Levinson ring a bell. Dan Hughes is our current police chief who some say is simply Pat Mckinley with a smile. Others revere him as the much needed solution to the problems plaguing The FPD.  

Barry Levinson, is a Fullerton resident who is a rare breed indeed. He is a civic minded individual who has the guts to tell it like it is and repeatedly ask the hard questions that most political slimeskins in this town wouldn’t dare to touch with a ten foot pole. Personally, the most perplexing questions that I still have, directly relate to Dan Hugh’s comments about the 33 minute and 33 seconds of video where Kelly Thomas was left for dead in the gutter after he was brutally beaten by officers of The FPD. Last night the issue was revisited with no exception.

In my opinion Fullerton is not healed from anything. No, the cancer is now in stage IV and the treatment plan costs are going to run into orbit from the Kelly Thomas murder, the fallout from the sham trial and the precarious termination of the officers.

The current Flory, Chaffee and Fitzgerald council members, in my opinion, still have their little happy parties and fluff gimmicks while holding the resident taxpayers in derision with their voting records. Meanwhile, Bruce and Greg struggle to keep the ship steered in the right direction in rough seas. Who will rise to the occasion in November? Will Barry? Perhaps yours truly?

At this point it is anyone’s guess. One thing is certain and that is Fullerton needs leaders and not lapdogs. Maybe whoever decides to throw their hat into the ring could use a refresher course on what courage really is and how to ask the hard questions. Weak, spineless, slimy politicians are what got us where we are. I say the hell with them and who needs them? Unless we can muster some real contenders coupled with some real civilian police oversight, we might as well leave the vampires in charge of the blood bank, lock our doors and stay home in November. I personally could care less about a few bucks added to my water bill every two months or a stinkin’ pothole if I still have to worry about getting beaten to death for not playing doctor with some deranged cop or framed like an picture at an Aaron Brother’s 1/2 cent sale.

By Barry Levinson | It is important to remind our city officials, the press and our community that our “new” police chief was our “old” captain who was the direct supervisor of officers Ramos, Cincinelli, Wolfe, Hampton, Craig and Blatney.

Anyone who is familiar with police work knows that the real training of officers comes not from the training officer but from their direct superior, on a day-in and day-out basis. That would have been then-Captain Dan Hughes. Therefore, I am disappointed that Chief Hughes has never expressed his regret that he obviously failed to train those 6 men adequately.

I have given Dan Hughes’ comments about his viewing the video over 400 times much thought and analysis. First, the video was 33 minutes and 33 seconds in length. It would have taken him over 222 hours to view that video 400 times. Should we believe that he spent five-and-a-half-plus 40-hour weeks reviewing the video while on duty, or even at home?

What about the actual comments he made concerning the contents of the video itself. His contention was that those police officers acted properly as seen on the video.

There are only two possible explanations for his comments.

The first reason is that he really believes that those six officers under his direct command were doing their jobs as he trained them or,

Second, he believed that the video would never be released to the public and so he felt safe siding with his men.

The first possibility shows that he is as guilty as any of those officers for not knowing the proper boundaries for police behavior. That is downright frightening.

The other possibility shows his willingness to mislead the public for his own benefit. This is not behavior that inspires confidence and trust.

But yet he terminated officers Ramos, Cincinelli and Wolfe presumably based on their actions that very night. What is the public to believe? The Acting Chief Hughes’s statements that after viewing that video over 400 times taking over 222 hours to complete, that he saw nothing wrong? Or the other Chief Hughes who terminated those three officers for their conduct that very night. Which Dan Hughes are we to believe?

Finally, when will the press, the public and every one of our council members, demand that he explain those glaring contradictions?

The FUJHSD has placed a $175 million bond issue on the

November ballot. The NOCCCD has placed a $574 million

bond issue for North Orange County on the November ballot.

The city of Fullerton when it has the chance to pass

meaningful public labor negotiation reform says no thanks

but we can sure pass a sham C.O.I.N. ordinance instead.

Finally, the city is attempting to ram down our throats a

huge undemocratic power grab by City Manager Joe Felz.

Another really bad idea from the same city that allowed the

bars in downtown Fullerton to expand exponentially in the

90′s and then at the turn of the century shackled the city’s

taxpayers with a huge retroactive pension increase for our

police and firemen that will eventually cost the taxpayer’s

10′s of millions of dollars under the guise that it would cost

the Fullerton taxpayers nothing at all.

Now don’t we all feel much better that our council passed a

meaningless resolution in support of Prop 13. I would not be

poking fun at this resolution if the majority of our council

were doing a good job with making policy that would create

a financially healthy and open city government. But the fact

is they have not even come close to that goal. In fact the

majority of the council I believe does not even have that goal

for the city and its citizens.

We need much better on our council and we better start

demanding much better from our council. If we do not

have the right mix of council members that want to do the

right things for our city, it is the public’s responsibility to

put enough pressure on those officials to force them by

overwhelming public opinion to do the right things despite

themselves.

Let us start with pressuring our city council to vote down the

DCCSP. It is a real shame that we as citizens have to force

some of our elected officials to do the right thing.

This is according to an article written by Robert Fellner on July 20, 2014.

The reason all taxpayers should be outraged by the final percentage of retirement income vs. final pay for OCERS retirees is simple.
The taxpayer cannot afford to pay these public servants that kind of retirement money.

It may be called a pension, but in reality part of it is simply welfare created by the unions’ cozy relationship with so many of our elected officials.
