Former members of the FPD were responsible for the brutal death of Kelly Thomas
The City of Fullerton hired Michael Gennaco and his office of “independent review” to investigate the incident. Michael Gennaco’s findings are posted here in this previously sealed confidential report.

Last night, a brave member of our community, Mr. Barry Levinson
asked the hundred million dollar questions.
MY PUBLIC COMMENTS CONCERNING THE PREVIOUS LEAKED CONFIDENTIAL REPORT (ENTITLED THE “INTERNAL AFFAIRS INVESTIGATIVE REPORT INTO THE IN-CUSTODY DEATH OF KELLY THOMAS by the OIR GROUP HEADED BY MICHAEL GENNACO) BEFORE THE CITY OF FULLERTON CITY COUNCIL ON SEPTEMBER 15, 2015 WITH SOME ADDITIONAL THOUGHTS by Barry Levinson
“The previously sealed Fullerton Police Department Internal Investigation concerning the brutal beating death of Kelly Thomas reportedly stated the following:
“Three of the four Fullerton police officers primarily involved in the beating death of mentally ill transient Kelly Thomas violated a series of department policies, including use of force, according to an internal affairs investigation report obtained by Voice of OC.”
The conclusions of this report issued in April 2012 well over a year before the start of the criminal trial of Ramos and Cincinelli, seems to contradict the sworn testimony of both Fullerton Police Department Training Officer, Corporal Rubio and Fullerton Police Department Sergeant Kevin Craig. They both testified that they saw no major violations of the Fullerton Police Department Policy Manual during the brutal beating death of Kelly Thomas and the subsequent police response to his injuries.
Question: Did FPD Police Chief Dan Hughes provide this crucial piece of evidence to the OC DA?
Question: Didn’t the failure to admit this crucial piece of evidence at the trial refuting the testimony of both Craig and Rubio help to achieve not guilty verdicts?
Question: Why hasn’t Dan Hughes suspended or taken other disciplinary action against both Craig and Rubio for allegedly committing perjury in a criminal trial?
Question: Why didn’t Police Chief Dan Hughes take action to open up a police investigation concerning the alleged perjury by two of his officers? Why did he not follow the same course of action for this alleged felony perjury case as his department did with regard to my baseless misdemeanor case that was later dropped by the OC DA for lack of evidence? Is it asking too much of our Police Chief to treat with the same seriousness an alleged felony perjury in a murder trial by two of his officers as he did with my bogus misdemeanor case?
To all of you on the dais, I ask for an independent investigation on the felony perjury allegedly committed by Sergeant Kevin Craig and Training Officer Corporal Stephen Rubio?
I sincerely hope that this council does not ignore what I have presented to you tonight.
We keep hearing in this chamber that the new Fullerton Police Department is doing everything possible to regain the trust of Fullerton residents. Clearly this confidential report shows us that a lot more needs to be done to regain that trust.
That concluded the statement I made during public comments at the September 15, 2015 Fullerton Council meeting.
PS: It is extremely informative to note that it was Council member Jan Flory who while I was in mid- sentence interrupted my 3-minute presentation. She attempted in vain to get our City Attorney to rule that this information that has been out in the public purview for several months could be blocked from being disseminated by a private citizen, yours truly. She also strongly inferred that I was doing something wrong by revealing the conclusions reached by this report penned by expert Michael Gennaco hired by our city to both make recommendations to fix our police department and report on the actions of those 6 officers the night of the Kelly Thomas beating death. Ms. Flory valiantly tried to keep the truth from the public last night. In my opinion this showed where Ms. Flory’s true allegiance lies and it was not with the public.”

Clearly we don’t. Since a jury clearly spoke. You would be surprised how many of the people that even know about this case say the right verdict was reached. No one intended for that person to die. So clearly the half brain might be your own looking in the mirror.

If any ordinary person had put on a pair of latex gloves and said “See these fists? They are getting ready to fuck you up,” then proceeded to put out a booty call for thugs to jump in and all together, beat, bludgeon, suffocate and electrocute a person to death, first-degree murder charges would be filed, convictions would immediately follow and sentencing would deliver up the maximum penalties. Such a dichotomy RI.

I agree Joe. You are correct. If your or I behaved in such a way, we would be facing a life sentence and jury deliberations would be over and done with within 8 hours max. I was suspicious from the get go. The DA hadn’t tried a case in decades. He had his hands all over this. They all worked together even right down to the jury selection. You would be amazed what was not allowed to be presented to the jury. I was there and I saw the faces in the audience and heard the sounds of the hearts breaking when the verdicts were read. These comments are from those connected to the officers, the defense, the DA or the police department.

Rocky please notice the silence from our city council on all issues relating to the FPD and its continuing failure under our current FPD leadership to keep us the taxpayer from paying out large sums of our money for their apparent misdeeds. I believe the city agreed to pay out $550,000 to settle (i.e. meaning the facts of the case will never see the light of day) the Detective Bair lawsuit. Either you are representing the people as a council member or you are not.
You can not claim to represent the people but then choose not to speak out on the leaked confidential Gennaco report, fail to ask for an investigation on the bogus claims against me last year, etc. Remember when asked by Jan Flory if Ms. Grisenti was touched by me, Ms. Grisenti’s response was “I do not remember”. In other words there was no case if the supposed victim doe not recall the bogus charges against me.
Did I receive a formal apology from the city council, the FPD or the city manager for this miscarriage of justice? Of course I did not receive any such thing. Silence by our council members should no longer be tolerated by the Fullerton citizenry.
Every council member must represent the people and always seek the truth. If they are unwilling or incapable of doing this, then we need to replace them.
The motto of every voter in Fullerton for the 2016 election, must be do the right thing or step aside!

Barry. Since you mentioned the continued failure of leadership. Please cite some examples. The settlement for Bair was from the old regime. Your case was simple. Someone said you touched them and then changed their story. So charges dropped. Gennaco repot wasn’t an issue either. Old news. It said policy violations. So what’s the big deal? We knew that already too. Or are you still conveniently combining the testimony of someone’s opinion with the opinion of Gennaco? No way anyone in this city would apologize to you anyways. You even know that. I think everyone in Fullerton is doing a great job over the last 3 years, even Chief DannyBoy. I think you are just stuck in the old days and refuse to accept that you will never run this city like you dream you will.

You refer to the old regime, when Captain Dan Hughes was the direct supervisor of the 6 officers involved in Kelly’s brutal beating death. Is that the old regime you are referring to Realty Is?
Too bad because I believe the Bair fiasco happened in 2011 when a guy named Dan Hughes was Acting Police Chief.

I just checked my facts and according to the OC Weekly article reporting on the Bair incident, Bair’s alleged innappropriate behavior started in December 2012 after Dan Hughes had been appointed permanent Fullerton Police Chief.
The OC Weekly stated as follows:
“The inappropriate behavior began soon after in December 2012, the suit charged, when Bair asked Castaneda for “sexy pictures” and made suggestive comments about her body after lunch at El Torito. Now, the city of Fullerton has agreed to shell out more than half-a-million dollars to settle the suit–yet another embarrassment against its police department”
Like I said before: Honesty they name is NOT REALTY IS!

I’d speculate that Reality Is probably Dan Hughes’ old high school buddy, George Crum.
Both came from Sunny Hills High School.
Last I heard he was the new Chief of Police in Cathedral City, CA.
Remember Detective Ron Bair standing up in front of the City Council immediately BEFORE the 2012 Fullerton City Council, and making a horse’s ass of himself trying to support the likes of Jan Flory and Doug Chaffee by demonizing the likes of Travis Kiger and Bruce Whitaker?

Now the whole department has been corrupt for years. Keep reaching. You link one article and one case, and now the whole department is bad. They have millions of contacts a year and one or two cases is all you can find? Departments will always have one or two or three or whatever lawsuits pending. All the time. Humans. If people can only find that many issues to complain about, that department and city is doing a great job. Humans will never be perfect. Even your own city council bought by your money and your own police department wouldn’t be that perfect. 🙂
