Yesterday, like most of you who live in the Fullerton Joint Union High School District (FJUHSD), I received a four-page color brochure from those bureaucratic “friends”.

This is the third full color brochure that has been sent out by the FJUHSD this year. Each time they have written that they are considering a new bond issue. Well, now they have set a date — August 5th, 2014 — where they will consider placing this $175 million bond issue on the November 4, 2014 ballot.
My understanding is that this bond issue will be long-term, maybe 25 years or so in length. It is irresponsible that the board would be considering this so late in the year.
This will increase our taxes for the length of the bond and citizens should have ample time to review the bond issue before it comes before the people.
First the board wastes our money by mailing 3 separate high priced color public relations brochures. Now they want to pass this bond issue with less than 3 months for the public to learn the details of both the cost of the bond and what supposedly the bond money will be used for within the district.
A responsible board would have proposed this bond issue at least 3-6 months earlier in the year. It seems the board purposely has waited until the very last moment to spring this very large bond issue on the public. A transparent and open board would not have waited so long. They still have not provided the public with the details we will need to make an informed decision.
We the public must be provided this detailed information as soon as possible about the need for the bond, a detailed accounting of where the money will be spent, and the specific cost of this bond issue over the life of the bond both in the aggregate and to each homeowner as well.
The district says it will “only” cost “the typical homeowner” approximately $50 dollars a year. Taxpayers must remember that the $175 million dollar price tag is the principal value of the bond. We the taxpayers are on the hook for all the interest as well which could increase the total cost of the bond 2 or 3 times.
Three PR color brochures, all have two things in common. First, they all provide almost identical information. Therefore, I see no good reason why the district spent the money on all three brochures. Second, all the brochures are lacking details which would help us make a reasonable and informed decision on both the necessity and the cost effectiveness of this bond issue.
In conclusion, the board should be embarrassed that they waited so long to consider placing this bond issue on our November ballot. The arrogance displayed by this board to present this to the taxpayers at this very late date is just incredible. Good governance requires better and we the people demand better from every member of this board. Be forewarned, that anyone who votes for this last minute bond issue will be targeted for removal from this board.

Anonymous, Mr. Righeimer may have stated that he supports the Fullerton Ordinance but when asked by unionwatch.org to spell out the key provisions of Costa Mesa’s C.O.I.N. ordinance, surprisingly his answer includes components missing from the Fullerton ordinance.
At Unionwatch.org an exclusive Interview with Costa Mesa Mayor Jim Righeimer on Transparency in Government has been posted. He was asked to compare Costa Mesa’s C.O.I.N. ordinance with the strengths and weaknesses of the Fullerton ordinance, his answer was non-responsive in my opinion. Please read it and decide for yourself. However, as indicated above, he was also asked what were the key provisions of the Costa Mesa Ordinance. His answer was the following:
“The first one is the requirement for an outside auditor calculate what the existing contract costs, right down to each line item. That needs to be in front of the public 30 days before negotiations begin. Then after that, you have to hire a nonbiased, independent person to conduct the negotiations. Nobody who may be impacted by the negotiations, such as management employees of the city, can be the prime negotiator. Also, every time there is an offer or counter offer that’s been countered or rejected, the details are made public. Finally, once an agreement is made it has to be scored at least seven days before any council agenda, and it requires two readings in council meetings before the public before it can be approved – just like an ordinance.”
Compare his answer to the Fullerton Ordinance and you can see how the Fullerton ordinance falls way short. The Fullerton ordinance will not provide the independence in negotiations, proper oversight, timely audited detailed cost information to the public prior to the contract signings, and timely public transparency necessary to give the taxpayer an equal shake in the negotiation process. In other words, in Fullerton the taxpayer is still getting the short end of the stick and will be stuck with a huge bill as usual. Another huge victory for the Fullerton city unions. So the very serious question remains and that is…. why do Mayor Chaffee, and Council members Fitzgerald and Flory seem to protect our Fullerton city unions over the people who elected them?

His answer was hardly unresponsive:
” so when mayor pro-tem Mensinger first drafted this for us, he covered every contingency he could think of. Whether or not all those contingencies were needed is debatable. the most important thing to have in coin is a third party negotiator, a total accounting of all the costs of the contract, and to have it presented at at least two council meetings so the public has a chance to look at it before its voted on.”
He’s basically acknowledging that every element of Costa Mesa COIN may not be needed.
He is also acknowledging the thee most important elements of COIN, all of which Fullerton has.
Fullerton’s COIN is reasonable, makes sense and is cost effective, removing the hair-splitting nuances of the Costa Mesa COIN. When very minor changes are proposed via the bargaining process, do you really need to bring in a third party at the rate of $300-plus per hour? In Costa Mesa, the answer is yes. Fullerton took that element and improved on it.
To say Fullerton’s COIN will screw the tax payers is beyond absurd. Fullerton is one of only two cities in OC with a degree of openness in the bargaining process.
You wait and see. A year from now, Costa Mesa’s ordinance will look more like Fullerton’s.
And to say that three council members are protecting unions is also ridiculous.
More than any other city, Fullerton council members and members of the public who regularly pontificate from the podium behave more childishly than first-graders.
It’s disgraceful.

It appears that you do not want to hear of any public opposition to Fullerton’s version of COIN. You come across as one that belongs to the established politicians, willing to fight against transparency in a city that has responsibility for, if I recall correctly, $182 M unfunded liabilities as reported in the OC Register a few weeks ago. That number represented pension liabilities, only. There was no mention of the health care liabilities.
Transparency and oversight is a good thing, and it needs to be sufficient to ensure that all proceedings are above board. The unfunded liabilities tells anyone willing to look objectively at things that stringent transparency is demanded.
The fact that the CM COIN was not used makes one wonder if these council members are trying to pull the wool over the taxpayer’s eyes.

Actually, despite what certain local politicians are saying, Fullerton fares better than many other OC cities regarding pension liability.
Fullerton’s ordinance calls for transparency and openness during every phase of the process.
Miss Fitzgerald hit the nail on the head when she said
ome people are just pissed that that new ordinance, as adopted, was not their idea.

We are just talking about Fullerton, here. It really doesn’t matter where we fall in the lineup, $182 M, is $182 M, and Fullerton taxpayers are on the hook for it and it is a huge number.

Please, stop the cheerleading. A $182 M unfunded liability demanded that the CM COIN was implemented. I have no confidence or place no trust in any of the council that voted against the CM COIN.

If the unfunded liabilities in Fullerton are $182 million, you should be very concerned about that, not busy defending a watered down COIN ordinance and one of the council members.
