 Pursuant to my rights under the California Public Records Act (Government Code Section 6250 et seq.), I ask to obtain a copy of the following items, which I understand to be held by your agency:

1) All transcripts in the possession of Dana Fox from the depositions of all of the Fullerton Police officers and FPD  and city employees during the Kelly Thomas murder trial and civil processes.

I ask for a determination on this request within 10 days of your receipt of it, and an even prompter reply if you can make that determination without having to review the record[s] in question.

If you determine that any or all or the information qualifies for an exemption from disclosure, I ask you to note whether, as is normally the case under the Act, the exemption is discretionary, and if so whether it is necessary in this case to exercise your discretion to withhold the information.

If you determine that some but not all of the information is exempt from disclosure and that you intend to withhold it, I ask that you redact it for the time being and make the rest available as requested.

In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any or all of the information is exempt and will not be disclosed.

If I can provide any clarification that will help expedite your attention to my request, please contact me at     714  or at ###########. Please notify me of any duplication costs exceeding $100 before you duplicate the records so that I may decide which records I want copied.

    Just curious. Aren’t the deposition transcripts actually owned by Ron Thomas and his lawyer team? They are just mandated to provide copies to the City since they were a defendant in this civil trial? So when the City says they don’t own the copies and can’t provide them, you have to go to Ron, but Ron has a gag order due to getting millions? Is that the snafu?

    And what exactly will we learn from these depos?
    We’ve all seen the video a thousand times and it speaks volumes more than any deposition ever could.
    Also, three cops have been fired and were charged with serious crimes.

    But I will say this … what the depositions will reveal is the kind of a person Ron Thomas really is, which is a far cry from the Ron Thomas who appeared in front of cameras

    You’re also making the request to the wrong agency. The depositions are sealed by the court. Fullerton does not have the authority to release them. Go talk to the judge in the civil case and see what he says.

    That’s what I’ve always said as well. It’s not like anyone is going to say much more than we already know in the depositions.

    Anyways, I’m sure Joe will be denied for some of the reasons mentioned. Time will tell. Then Barry will get mad and yell it’s a conspiracy against him.

    Yawn.

    No. It’s the truth. As it’s been stated many times, many people used the death of Kelly Thomas to get their 15 minutes of fame. Cops were charged with crimes and fired. A police chief resigned. Three councilmen were recalled. It’s over. The merry-go-round has stopped. But it is in the best interest of some very specific rogue individuals – who don’t come within an eyelash of representing the opinion of the masses – to continue to keep the Kelly Thomas tragedy alive. It’s all they have to validate themselves. Why take the proper channel and go before a judge to request that the depositions be made public when you can put on a whole show at a council meeting or on blog and say how the city is unresponsive?

      and the perfect example of that is Ron Thomas. He just wanted the camera time and he made promises to the world. Once the cash was on the table, he took it faster than anyone could blink. All of his promises of never settling and getting the truth in a trial from everyone was just a farce. Kind of like how he abandoned Kelly for years on the streets. But when the chance for money came, he was right there doing his dirty work.

      That’s a pretty asinine view if you think that standing up to people who beat a shirtless 137 pound mentally ill homeless man to death is 15 minutes of fame.

      It’s quite the opposite.

      Maybe you should have tried standing up to these bullies if you think it was so glamorous?

    …I think the part I find most offensive is that every one of these horses asses is still being paid and is working in Fullerton, and the other cops find pleasure in demonizing the likes of Joe Imbriano and Barry Levinson for calling them out on it.

    Your parents must be so proud of the bullies that they’ve raised.

    You know what. You’re right. You’ve convinced me. I think The depositions and should be released. I mean there was nothing about the incident itself that will come out that isn’t already known. But here is what will be revealed: We will read sworn testimony about Ron Thomas, in the days following Kelly’s death, was at the transportation center pimping the gruesome photo of Kelly to the highest bidder. And we would learn how much Ron received for the photo. We will also read all about Ron’s, uh, “nonprofit” and where all the donations to KTMF went. Remember all those Justice for Kelly t-shirts that were being sold. Got to figure at least a few thousand dollars worth. Ever wonder where all that money went? It didn’t go to causes related to homelessness, that’s for sure. I bet Ron knows the answer.

    I got it from a reliable source. Ron Thomas went and bought himself a brand new Corvette. I guess he had to buy it to cover his grief. He was in so much pain. BoooHooo.
