So the night of May 25th, the Planning Commission was to vote on part of the revised DCCSP…the Overlay Zoning Change. As you may recall the revised DCCSP consisted primarily of three new “zoning tools” of which the overlay zone was the key one in my opinion. If something stinks, i.e the original DCCSP, you do not eradicate the smell just because you made your awful plan smaller. Could this be the diabolical mind of Joe Felz with the assistance of Mayor Jennifer Fitzgerald at work?

Fast forward to the May 25, 2016 Planning Commission meeting, Commissioner Bennett was allowed to go off topic for well over 5 minutes until the assistant city attorney finally told him he was off track. Mr. Bennett sarcastically indicated that there was absolutely nothing to the internet stories that Polly’s Pies was in danger of being replaced by apartment buildings. He went on to say that the DCCSP was dropped by council almost 2 years ago never to rear its head again.

I had to get up and tell Mr. Bennett during public comments that in fact the city, (i.e. Joe Felz) brought before the Planning Commission by Karen Haluza, the Director of Community Development just a few short weeks ago with Mr. Bennett in attendance to pass the “Revised DCCSP” agenda item.

This included 6 specific parcels of land (including where Polly’s Pies is located) to be a part of this overlay zone change, which would overlay the right for those 6 retail/commercial parcels to build mixed-use properties including hundreds of apartments without needing any further zoning changes. Obviously, this was a brazen attempt by our city leaders to bring high-rise mixed-use development that much closer to happening at those 6 parcels they spelled out in the newly revised DCCSP. But according to the likes of Mayor Fitzgerald, Council member Doug Chaffee and other city leaders, they are trying so hard to get retail tenants at Raymond south of Chapman. What a bunch of baloney they are feeding us Fullertonians. If that Revised DCCSP would have passed it would have reduced the percentage of commercial retail space in the city from the paltry 6% to an even lower percentage. Where are those people living east of Harbor Blvd. and west of the 57 freeway supposed to shop or buy groceries if the city got its way? Answer the city of Fullerton apparently could care less about that lack of shopping in that neighborhood. They desperately need the money they would collect in Park Dwelling Fees in the amount of $11,700 per unit. They have already contractually agreed to spend millions upon millions of additional dollars in the form of large raises to the Fullerton Police and Fire knowing they were already in the red $2.8 million. Remember several months ago the city’s plan for the College Town proposal would have replaced Smart and Final and other shopping at Chapman and St. College replaced with more of the same mixed-use high rise apartments.

 

How disingenuous can a Planning Committee member be Mr. Bennett? By the way not one member of the dais attempted to correct Mr. Bennett’s very deceptive comments.

This man wants to be your next council member. We need Mr. Bennett like we need a hole in our collective heads.

Remember he represented the NO on Recall campaign.

He has benefited from 10’s of thousands of dollars from the city unions in his last campaign. We need courage, independence and honesty but we certainly do not need a candidate like Larry Bennett.

P.S. Thanks to the city’s new rules for our public meetings, we the citizens only have 3 minutes rather than 5 in study session public comments and still I was interrupted several times by Chair Shanfield and once by none other than Larry Bennett. Are you not tired Fullertonians that our leaders think it is okay for them to ignore the same rules they demand and require us to follow! It was at that same council meeting that the Mayor, Ms. Fitzgerald admitted being front and center in proposing new restrictions on the rights of the public during public meetings including the right to “clap”. The arrogance of that attempted move by Mayor Fitzgerald and the other author, City Manager Joe Felz is beyond the pale!

Seriously Fullertonians do any of you have any confidence that Mayor Fitzgerald and City Manager Joe Felz will do the right things for the people in the future just based on that one outrageous attempt to stifle the rights and freedoms of the people at our official city public meetings?

Don’t you wish, Fullertonians, when someone in an official city capacity such as Commissioner Larry Bennett misleads the public about official city business, that it should automatically disqualify him for any pubic office?

I believe if our city government had integrity that is exactly what should happen next. But then again, this is the City of Fullerton Government where pretty much anything goes, even trying to have an innocent person thrown in jail and another innocent person beaten to death at the hands of members of the FPD. And now that the truth is getting out and more and more people are getting educated, and the establishment is getting extremely worried. Look for them, including those you would least expect, to go after the messenger and not the politicians with their forked tongues any day now.

    Have you all noticed how city hall establishment people such as Larry Bennett are speaking out in unison to support the city hall deception that the city has no interest in making it not only possible but much easier for current landowner at the Polly’s Pies shopping center to convert it to a 300 to 500 unit apartment high-rise monstrosity with only a few small retail shops on the first floor. This would reduce the already undersized retail spaces (now only representing 6% of all land use) within the city and especially in the central eastern part of town. Larger retail space such as a grocery store, a car parts store or large eatery such as Polly’s Pies would no longer fit into the scheme that the Overlay Zoning ( i.e. Mixed-Use) would bring to Fullerton.

    The city is in a very bad financial situation. The city passed a two year budget last year with a built-in 2.8 million dollar budget deficit and then ignored their fiduciary responsibilities to the people by handing out extremely generous 6% and 5% raises to the police and fire, while the city infrastructure is probably the worst in Orange County. Now they desperately need the $11,700 per residential unit Park Dwelling Fees to keep the city above water and to literally bail them out for continuing to take care of their special interest city union friends to the detriment of the rest of Fullerton.

    It is all about the special interests whether it is the city unions or the developers. Part of what makes a city a healthy financial entity is having a diverse and solid tax base. Fullerton does not have that with only 6% retail/commercial. Rather than trying to increase that percentage the city is salivating on the one time $11,700 fee and reducing the tax base by substituting retail/commercial with high-rise housing.

    Why do you think, Commissioner Larry Bennett did not respond to Mr. Levinson’s pointed comments? As Commissioner he has all the time in the world to speak, unlike the citizens he is supposed to represent, who have a measly 3 minutes less the time they are interrupted by commissioners. He did not respond because he knew he got caught in going out of his way to present a false narrative about the just recently presented Revised DCCSP to the Planning Commission. Today many if not most politicians apparently believe if they say an untruth often enough that the citizenry, not paying close attention, will accept it as the truth. Thank you Mr. Levinson for not allowing Mr. Bennett to misrepresent the facts to the people of Fullerton. It is clear to me that he is not someone who deserves any consideration for city council. The fact that he apparently has the support of so many elected officials including Mayor Fitzgerald, Supervisor Shawn Nelson, Council member Doug Chaffee, etc. taints all of them.

    George Carlin a great satirist and philosopher had a wonderful way to humorously boil politics down to the nitty gritty.

    In one routine, he said that the idea that Americans have choices when they go into the voting booth is just an illusion perpetrated on the people. In Fullerton that sentiment has some very real validity.

    Time and time again our so called leaders on the city council and/or their appointees on the various committees almost always choose to side with one another rather than the public. When a citizen legitimately points out a misrepresentation by someone on the dais, the rest of the members on the dais circle the wagons to protect “their own”. Their sense of fairness or right or wrong seems to fly out the window in favor of primal protection of their colleagues.

    If there were real differences between our leaders you would think that this would not be the case.

    Unfortunately in Fullerton it really isn’t liberal vs. conservative, or Democrat vs. Republican. It is really the insiders vs. the outsiders. It is special interests vs. the common folk.

    As of today I am one of the few outsiders on a city committee. I do my job to the best of my ability with the sole goal of representing the people of Fullerton well. It strangely puts me constantly at odds with my fellow committee members, council members and other city leaders.

    The city council opens each meeting with an invocation asking God that they may make the right choices and represent the people well. However, a few moments after the end of the prayer, it seems that other political and selfish priorities seem to take center stage and it turns out that doing right by the people was only a quaint antiquated idea that few if any of our council members really believe in.

    Well until the vast majority of council members we elect take the invocation seriously, our city government will continue to be a great disappointment to us.

    I talked to the owner of the property. He said he could just let the property sit 75% vacant if you want for 5 years. He’s fine with that. He’s rich. Or he could make it a better community for all. Money is no object to him.

    Larry ignored you? Are you seeing the pattern? If you cry and whine and insult 24:7 and never give an atta boy to anyone at anytime, when you cry wolf the one time it means something, no one will be listening. No one in city government listens to you Barry. It’s unfortunate but I understand it. Like I told you many times; you would get a lot more credit if you gave good workers and good people kudos for good work when they do it. Police and Fire and City employees do good work everyday.

    One of those annoying douches who apologizes before saying something horribly offensive, ignorant, or demeaning to you. The apology is supposed to make it nicer somehow–or they’re attempting to be PC (which is annoying as well).

    These type of people also lose credibility on their beliefs since it conveys less confidence about their beliefs.

    I have never RI criticized Fullerton city workers as a group….NEVER! I point out when city leaders are not being straightforward with the people they are supposed to represent. I also point out how way too often our city council members represent the special interests to the detriment of the average Fullerton citizen. It is so, so sad that you have no problem with such behavior from our elected leaders in Fullerton. By the way Mr. Bennett did not ignore me but was smart enough not to dig a bigger hole for himself by defending the indefensable

      You and Joe have a slick way with words. Did I say that you criticize as a whole? Or did I say you fail to ever recognize good work and good efforts by city workers? I think you gain a large mount of credibility if you didn’t take the stance to never recognize good work done by dedicated city employees. All of them. Police. Fire. Council. Human resources. I’ve waited for years to hear just one time you say something good or recognize their hard work. But I haven’t ever seen it and I know I never will. Is what it is. So you changed what I said but I just made clear what I said.

        I have gone on the record RI praising Captain Kevin Hamilton for taking the FPD lead in helping my wife and me put together and pass Ordinance 3149 to help protect Fullerton children from sexual predators. He presented the draft ordinance to the council way back on September 21, 2010. I also thanked the assistant City Attorney who drafted the ordinance as well.

    Note that at 2 minutes and 55 seconds into your comments, that Lairy Bennett’s attention is drawn to the person on his right, which if memory serves me correctly, is where the representative from the city attorney’s office.

    Even the City of Fullerton website refers to the 4/13/16 Planning Commission Agenda Item as the Revised DCCSP. Let me get out my advanced calculator. 4/13/16 is approximately five weeks before the 5/17/16 Planning Commission meeting date. Commissioner Bennett tell us again how you calculated that it was almost 2 years ago according to you that the City of Fullerton finally ditched the DCCSP idea for good? Either Mr. Bennett has a severe case of Alzheimer’s disease or he was telling a very big fib. Why is it that so many politicians lie so easily and often?

    Why does the Fullerton public allow any of our elected and/or appointed officials to lie to us without paying a price for their intentional deceptions?

    Here is a novel idea. This year let us send a resounding message to all the corrupt politicians by sending them packing.

    Let’s start by sending say nothing and more importantly do nothing Jack Bedell, RINO establishment Republican packing and ELECT ZONYA TOWNSEND to represent us on the Orange County Board of Education. She will represent the people.

    I spent over an hour listening to Mr. Bedell supposedly speak about Common Core. He talked around the issue the whole time but wasted the public’s time speaking gloriously about himself. Finally when pinned down he said he could do nothing to get rid of Common Core, which meant he would not lift a finger to get rid of Common Core in our Orange County public schools. What a narcissistic empty suit.

      Did you know that Fullerton Police Officers Association (FPOA) sponsored Larry Bennett’s campaign for the City Council seat in 2012?

      Did you know that Larry Bennett was also the campaign manager to defend the three city councilman who were recalled from office by the residents of Fullerton?

      Did you get an invitation to sponsor Jennifer Fitzgerald’s city council for $2,500?

        I guess that $200 was the minimum price for a couple to mingle with the influential and powerful such as Curt Pringle and Jennifer Fitzgerald. Since I have no business interests coming before the Fullerton City Council, I personally would not be inclined to give the Mayor $200 or more of my hard earned money. In fact, I thought this was all about Fullerton and Fitzgerald’s Love of Fullerton. Yet the event was not even held in Fullerton but in neighboring Anaheim. Maybe it is not about the people of Fullerton at all.

    What is really sad is that Fullerton City Council candidate Larry Bennett has repeated his misleading statements about the DCCSP while campaigning? Please note that I am not criticizing him for his positions as much as I am pointing out that he has been misleading the public with those comments. How can the Fullerton public make informed choices if the status and facts about important past agenda items are not being presented accurately? A politician who claims that an agenda item is dead and buried, while the city council only postponed action on the item to a date uncertain is clearly not be totally forthcoming with the Fullerton public.
